That sounds like bullshit. We can foia documents in SC whether it is on a public email server or not; the question is whether the emails engage to actions taken in an official capacity. Also, sensitive docs relating to police preparations for security would probably fall under an exemption to disclosure. Pretty sure the federal foia is the same. Maybe VA's foia is different, but I wouldn't think it is that different.
Hypothetically, yes. I guess my point is they always seem to find a way to fall short. This is a good thing.
