    I got two outs. I either give her some money and its worked in the mediation hes gone from the company.

    OR

    Since I changed his hours from 8-4 to 6-2 to help them out so he could get a 2nd job, I am going to say its not working out at 6-2 and I need someone in his position to work 9-5. Now you cant do both jobs fucktard

    I was purposely vague because it's hard to articulate while maintaining the comparison.

    The first firm (let's call it Firm A) is a one stop shop that would permit me to dabble in practice areas that interest me (within reason and assuming I meet my other obligations, obviously), while also permitting (at their expense) me to venture into niche practice areas they don't currently serve if there is some potential for obtaining business there.

    The second firm (let's call it Firm B) is more of a boutique that focuses on certain practice areas. The growth at Firm B would be due to me expanding my current practice but staying in the larger field.

    I do tax, and would continue doing tax at Firm B. At Firm A, I would be able to do a lot more than tax over time. However, I want to ultimately stay in the field of tax. Firm A would simply permit broader experience.

    Naw I give my people everything. I thew them a baby shower at work, gave them 3 weeks extra paid leave (which in Florida there is no maternity leave), worked with them for their schedules to make it work. Gave them both an extra mid year bonus for the process. Then she refused to do part of her job and said she shouldn't be doing this anymore and blah blah. She refused to sign a probation letter with her job duties and what she needed to do better. So I gave her her termination letter.

    Now it angers me that shes suing me and I am still paying the husband to work here.

    Option 2 sounds a lot like retaliation for his wife suing you. Probably best to get it wrapped up in mediation along with a full release from him.

    A sounds like a better career opportunity. But B sounds like an easier lifestyle. Are you at a point in your career that you're willing to work and adapt, or are you content to ride the wave you're on, albeit at a new place? Depending on your personality, I could easily see how two different people would look at each opportunity as one that brings more happiness; it just depends on whether you define happiness as challenging/exciting work environment versus shorter hours.

    Thats ideal. And of course its retaliation. He does my receiving and shipping. I can show that FedEx Ground, DHL come after 3 pm for delivery. I need someone here at those times. So it would all work out. I just want this done Monday. Just found out my uncle had an unexpected heart attack and died last night. Mediation on Monday is my birthday. Lifes great :roll:

    Yeah, I’ve gotten to where I don’t want to do the long hour thing anymore. Option 2 would be my play. And my guess is that you will be able to dabble in any practice area provided you can demonstrate to the partners that it will make money.

    That pretty much nails it, and is the way I view the options.

    Fortunately, I am at a point where I could do either option, but I'm seeking different perspectives in case there's a factor I'm overlooking. Because the money is the same (and will likely stay roughly the same over the long term), it's an easier lifestyle, and there is less uncertainty as to what I'd be doing day in and day out, I'm leaning towards Firm B. But the fact I'd be closing a door on potentially a great career opportunity is causing me to pause and question myself.

    I hear you. Good problem to have. Got to go with your gut. The good news is, because you're human, you'll likely rationalize your choice to convince yourself that you made the right choice, regardless of the outcome. So really, you can't lose.

    That’s the way I’m leaning. There are other things I’ve omitted that favor/disfavor both firms, but option B makes the most sense from a lifestyle perspective.

    FWIW the majority of practicing attorneys in Birmingham I’ve spoken to have said option A largely because of the firm’s reputation. That’s one of the reasons I haven’t committed all the way to firm B, but likely will.

    Is the husband a party to the case? If so, under the mediation privilege, the employer could still make the offer and it couldn't be used against him if they refuse it. In fact,if the husband attempts to bring it up again outside the confines of mediation he could be liable for breaching confidentiality.

    Don't be too short-sighted. If option A affords you the opportunity to start building your own niche practice at the firm's expense, then take option A. In the long game, you ALWAYS take the opportunity that affords you more control of the work/clients/money. That way you have the leverage in the future to either bargain for a better compensation package, or bail and hang your own shingle if you have enough work to support yourself. If you take option B, you'll mostly be relegated to working on other people's shit, get strung along by older partners who will promise you that they "plan to retire in 5 years," and then you'll find that 10 years have gone by and you have no book of business of your own and therefore no leverage.

    Can comp subro from UM in your state? If Class II insured, does that make a difference?
    Can UM med pay offset from UM BI coverage in your state? If verdict>limits?

    Just curious, up against both these situations currently.

    Great points, and the pressure of building a book of business has been something I’ve thought about a lot these last few days. I hadn’t thought about using it as leverage, though. That’s something I will have to consider more.

    At Firm A, most of the clients are large corporations, so I’d need to maintain relationships more than bring in new business. At Firm B, most of the clients are high net worth individuals and their closely held businesses, so there’d definitely be more pressure to bring in new clients. I asked a partner at Firm B today about this, and he said it’s not kill what you eat but it does alter variable comp.

    Firm B readily matched moving expenses and signing bonus that Firm A offered. Not long after and without me saying a word, Firm A called and asked if they could take me and my girlfriend to dinner next Thursday in the city we live in, and in which Firm A has no office.

    Starting to think I’m leaving money on the table, but since it’s the deep south I don’t know if it’s worth pushing too hard.

    Won a civil trial last week, won a criminal jury trial today, and my clients torpedoed their own domestic trial yesterday. Those were my first 3 trials. Feels pretty good man.
