Does anyone else use a bluetooth at work? When I'm at the office I'm on the phone for hours each day. Would feel like a tool but might be much better than holding a phone up to your ear all day.
It’s also carried over into my cell phone use, but just with headphones. I can’t remember the last time I actually held a phone to my ear
is there anything more annoying that someone calling you out for having them on speaker at work and asking you to take them off speaker? I have clients do that all the time.
Just spoke to a gentleman who claimed to be an attorney and that he was representing his wife. He is, in fact, not a licensed attorney and is instead a realtor as far as I can tell. Our conversation after I found that information sure was fun.
Spoke to the bar and was told they only deal with licensed attorneys. Apparently the managing authority for the unauthorized practice of law is the attorney general in his state. Still working on it.
Are they known in your area? Not sure getting the guy a criminal charge for helping his wife is the best move for you if they are active in your community, ie this guy is about to bad mouth you for the next decade.

Driver is 14. One of the guys they hit flashes a gun at them and starts chasing them. They freak out and floor it through an intersection at a red light and plow into a woman’s truck, killing her. This is entirely out of my practice area but isn't it weird that the kid is charged with murder but the guy brandishing the gun/chasing them isn’t charged with ANYTHING? That seems wrong to me but I guess it's Texas.
currently studying for my 2nd bar exam (this one in Colorado. TN wasn't UBE at the time), I concur that this seems like a tort or criminal negligence fact pattern.
Just a guess, but I’m assuming the only evidence of the gun and chase is the kid’s statement. They did identify the driver (who is cooperating), so the kid was at least partially telling the truth. And they could always bring charges against him later, of course.
Guessing there is no theory of negligence if someone eats shit on a bird scooter? Seems like I hear once a week about someone seriously injuring themselves on those things. It’s a felony murder charge, which probably stems from the teen driver being 14, so that seems normal to me. Think we’d need more facts about the brandisher - could see it as a plausible self-defense claim, could just be Texas depending on the rest of the circumstances.

Sorry haven't kept up with this thread. Probably not, has it been indicted? Depends on the difference in age between victim and your guy and obviously how that polygraph comes out. Before we dismiss a case or offer probation we almost always require a polygraph and/or psychosexual evaluation.
Yes. It's not a deal breaker, but take it into consideration. These cases rarely have any sort of physical evidence (delayed outcries in the majority of cases so any clothes have been washed or thrown away and SANE exams are generally worthless), so we have to use everything we can when accessing everyone's credibility.
I get that it's really the only thing available, I just can't imagine using it for anything except partisan argument. I put zero stock in the reliability of those exams, especially one done in isolation. The studies on them are horrible.

Yeah I settled a couple of my more work intensive cases in December. I intentionally tried to make it so my early January wasn’t a shit show. Now here I am, sitting in my office, unable to complete an email to a client and reading every thread on TMB. I’m one of those folks that has no problem working 15 hours in a day when I have a shitload of stuff to do; but lord forbid my workload lighten up a bit and there goes motivation. Got what I asked for I guess.
Man I love dealing with Canadian adjusters/insurance company. Dealing with one called Economical Insurance. They paid me over 3 times meds on a soft tissue MVA with only a trip to the ER for a minor child. Then they sent the checks with just my firm name and not the clients name on it. They didn't bug me about any liens. They didn't ask about filing the petition for minor settlement. They didn't ask about the order approving same or anything else. As soon as we verbally settled it I had a release and a check. LOL Getting this stuff approved in court today. Always hate when a minor clients dad is incarcerated and trying to get notice or waiver to them. Sent this guy a waiver to his prison and never got it back. I think the judge could techinically decline to approve settlement until dad gets notice or waiver. There's also stuff saying that after you've been imprisoned for a certain amount of time your parental rights can be terminated. But I don't have a decree terminating his rights. /rambling
