    SAN DIEGO (AP) — A Navy SEAL called by prosecutors to testify at the murder trial of a decorated comrade dropped a bombshell Thursday when he acknowledged killing the victim in what he described as an act of mercy for the wounded captive Islamic State fighter.

    Special Operator 1st Class Corey Scott said he asphyxiated the adolescent prisoner in Iraq two years ago after Special Operations Chief Edward Gallagher unexpectedly stabbed him.

    A visibly angry prosecutor accused Scott of lying, saying he had told investigators a different story over the months and changed it only after being granted immunity by a judge and ordered to testify.

    The testimony was a major boost to Gallagher, who is fighting charges of premeditated murder in the boy's death and attempted murder in the shooting of civilians.

    Before the stabbing, Gallagher and Scott had stabilized the sedated prisoner who was wounded in an airstrike and he was breathing normally through a tube inserted to clear his airway.

    Scott said he was shocked when Gallagher, the platoon's leader, stabbed the boy at least once below the collarbone. He said there was no medical reason for it. Gallagher then grabbed his medical bag and walked away.

    "I was startled and froze up for a little bit," Scott said.

    Scott said the boy would have survived the stabbing, but he plugged the youth's breathing tube with his thumb because he believed the prisoner would eventually be tortured by the Iraqi forces who captured him and delivered him to the SEAL compound for medical treatment.

    Scott met repeatedly with investigators and never revealed he had anything to do with the death, John said. He had always asserted that there was no way to save the prisoner's life.

    Scott said no one asked him how the patient died and acknowledged the immunity deal allowed him to finally fess up.

    He wanted to invoke his Fifth Amendment right against self-incrimination when called by the prosecution, but the judge rejected that. Capt. Aaron Rugh granted him immunity and ordered him to take the stand.

    The testimony follows another serviceman who described the stabbing and a former SEAL who said Gallagher later scoffed that the victim was "just an ISIS dirtbag."

    The former SEAL, Dylan Dille, also described several instances when he said Gallagher had fired at civilians, once shooting an old man.

    Scott said he did not recall previously telling investigators that Gallagher had shot women and children.

    The defense has said Gallagher only treated the prisoner for a collapsed lung and that disgruntled sailors fabricated the murder accusations because he was a demanding leader and they didn't want him promoted.

    "I knew he was going to die anyway, and I wanted to save him from waking up to whatever would happen to him," Scott said.

    Scott was the fourth SEAL to take the stand and second to say he witnessed the stabbing. Prosecutors have alleged that the stabbing killed the boy.

    The prosecutor, Lt. Brian John, accused Scott of lying, saying he had changed his story only after being granted immunity that prevents him from being charged in Shitty AMC Show.

    "So you can stand up there and you can lie about how you killed the ISIS prisoner so Chief Gallagher does not have to go to jail," John said. "You don't want Chief Gallagher to go to jail, do you?"

    "He's got a wife and family," Scott said. "I don't think he should be spending his life in prison."

    WASHINGTON—The Supreme Court on Friday reaffirmed its strict rule against racial bias in jury selection, voting 7-2 to overturn a black defendant’s murder conviction by a Mississippi court after a prosecutor dismissed 41 of 43 African Americans from jury pools.

    Writing for the court, Justice Brett Kavanaugh said it was unnecessary to break new legal ground. But the “extraordinary facts of this case” required the court’s intervention.

    Justice Clarence Thomas, joined by Justice Neil Gorsuch, dissented.

    Most trial courts allow lawyers to exercise a number of peremptory challenges during jury selection—that is, dismissing potential jurors without providing a reason. But in a 1986 case, Batson v. Kentucky, the Supreme Court held it was unconstitutional to do so based on race.

    Starting in 1997, Doug Evans, the district attorney in Winona, Miss., prosecuted Curtis Flowers six times for the same crime. Two trials ended with hung juries, while three convictions with death sentences were overturned by the Mississippi Supreme Court for prosecutorial misconduct or racial bias in jury selection. The fourth conviction and death sentence—in 2010, by a jury with 11 whites and one black—was upheld by the state courts.

    At oral arguments in March, Justice Kavanaugh—wrote a law review article on the Batson case as a law student—he said the precedent sought both to protect individual defendants from racial prejudice and promote public confidence in the justice system.

    Mr. Flowers was convicted of the 1996 killings at the Tardy Furniture Store in Winona. The victims included the owner, Bertha Tardy, 59 years old, and three employees, Carmen Rigby, 45; Robert Golden, 42; and Derrick Stewart, 16.

    Mr. Flowers, then 26, had worked at the store, but no physical evidence tied him to the crime scene. Prosecutors argued he killed the victims in revenge for being fired.

    So excruciating for the Bible family. I think they mentioned looking in some abandoned mines, and I know I saw them digging down to the foundation of an old house.

    Hopefully there will be some resolution in the last episode (tom. HLN 9pm). Will also be interesting to see if anybody else in that town knew something but kept quiet about it.

    Chick (arrested) turns in husband’s guns because she thinks he will kill her when he gets out of jail:



    A 32-year-old woman was arrested on June 15 when she gathered her husband’s guns to turn them over to the Lakeland Police Department.

    According to Courtney Irby’s arrest affidavit, she told police her husband had been taken to jail for trying to run over her with a car. Irby said she went to Joseph Irby’s apartment on Village Center Drive in Lakeland and searched for the guns she knew he had.

    When she told a Lakeland police officer she had the guns with her to turn them in, he replied, “So are you telling me that you committed an armed burglary?” and Irby answered, “Yes, I am, but he wasn’t going to turn them in, so I am doing it,” according to reports.

    Police verified Irby had never stayed at her husband’s apartment until the day of the burglary.

    Officers made contact with Joseph Irby, who was still incarcerated at the Polk County Jail, and he said he wanted to press charges against his wife for entering his apartment and taking the guns, reports say.

    Court records show that Irby applied for a temporary injunction against her husband and the two were in the process of a divorce.

    She was charged with armed burglary of a dwelling and grand theft of a firearm.

    State attorney throws out 17 convictions after TPD fires 3 officers

    TAMPA, Fla. -- The Florida State Attorney's Office threw out 17 convictions on Wednesday.

    The decision comes after the Tampa Police Department fired three officers for violating department policy.

    TPD Chief Brian Duggan said it all started in September 2018 after someone complained about officers Mark Landry and John Laratta threatening them. TPD launched an investigation on 11 of its officers, including Landry and Laratta.

    Landry and Laratta were fired after the investigation. A third officer, Algenis Maceo, was also fired. Seven others were reprimanded.


    Duggan said the officers violented department policy by withholding evidence, not making arrests, failing to file police reports and in some cases, shutting off their body cameras.

    The disciplinary actions forced the state's attorney office to drop five pending cases. Then, they had to review over 220 closed cased, which led to vacating 17 convictions, even though all 17 entered a guilty plea.

    "The decision here was based on a process that violated basic standards of due process and fairness because of a lack of credibility of these three officers," said state attorney Andrew Warren.

    Alaska teens allegedly killed friend after man offered $9 million to record "rape and murder"

    Anchorage, Alaska -- An Indiana man implicated in the murder of an Alaska teenager had allegedly promised millions of dollars to the teens who killed her in exchange for images of Shitty AMC Show, CBS affiliate KTVA reported. Court documents say that investigators believe Darin Schilmiller of New Salisbury, Indiana, posed as a millionaire named "Tyler" online and offered 18-year-old Denali Brehmer $9 million or more to "rape and murder someone in Alaska," the station reported.

    Brehmer was supposed to send photos and videos of Shitty AMC Show back to Schilmiller, according to the court documents.

    On Tuesday, Schilmiller and Brehmer were indicted on child pornography charges, KTVA reported. The pornography was discovered while police were looking for evidence related to Hoffman's murder on Brehmer's phone. Text messages between Brehmer and the man discussed plans to sexually assault a minor and contained videos of Brehmer performing the act.

    Watched E4 of Hell in the Heartland.

    Law enforcement seems terribly corrupt (at least when the event happened). Sounds like lots of people knew the truth, but kept quiet so they didn't end up at the bottom of a mine shaft.

    The current sheriff was trying not to disparage his predecessors, but that box of evidence apparently sat on a shelf for 18 years.

    Did that house toward the end of the episode belong to one of the three suspects (one who has since died)? I didn't catch who had lived there. The current owner said it was never searched. Looks like it's just boarded up now.

    That house belonged to Pennington, 1 of the 3. All those idiots admitted it but people were too scared to say anything until recently. The random guy that pulled up in the truck to talk about the other guy admitting it is a MAJOR witness. Hearsay will be admissible with an admission like that, however an admission can't be the only evidence (corpus delicti). It is a tough case against this guy for the state from what I gathered.

    It's amazing the amount of people that have blindly comed to this guys support. The guy is a piece of shit human being but toxic troop worshiping has made it so even if you suggest he might be guilty your an Isis supporting antiamerican.

    (CNN) When the trial of a decorated Navy SEAL opened in a San Diego military courtroom Tuesday, prosecutors promised jurors would hear from witnesses who saw the special warfare operator plunge a knife into the neck of a wounded ISIS prisoner.

    But by week's end, one of the prosecution's own witnesses dropped a bombshell, testifying that he was the one responsible for the ISIS fighter's death, not Chief Petty Officer Eddie Gallagher.
    It was an extraordinary twist in the court-martial's opening days, but just one of many revelations. Other witnesses testified that during their deployment to the Iraqi city of Mosul in 2017, they saw Gallagher not only stab the young ISIS prisoner, but fire at non-combatants, including a young girl estimated to be between 12 and 14.

    "The thing floating over our heads," one SEAL testified, "was that our chief was killing civilians."

    Gallagher stands accused of multiple violations of military law, including murdering a prisoner, posing for a photo next to a corpse, shooting at non-combatants and intimidating SEALs who might report his behavior.
    Gallagher has pleaded not guilty. If convicted of murder, he faces life in prison.
    The case has caught the eye of President Donald Trump, who has expressed sympathy for Gallagher on Twitter and is reportedly mulling a pardon for the SEAL.
    Gallagher's defense attorney, Tim Parlatore, told the jury of seven men in his opening statement Tuesday that there was no credible physical evidence for the murder charge against his client. The witnesses, Parlatore said, all had "an admitted hatred towards Eddie." He echoed those remarks later in the week, saying "the younger millennial SEALs" were targeting Gallagher because he was "old school."
    "This case is not about murder," he said Tuesday. "It's about mutiny."

    'It's just an ISIS dirtbag'

    Prosecutors began calling witnesses Tuesday afternoon, starting with Officer Thomas MacNeil, a SEAL who served alongside Gallagher. Under immunity, MacNeil told he court he posed in a group photo with the body of the ISIS fighter Gallagher is accused of killing, but that he didn't know the circumstances of the prisoner's death at the time.
    Later, Gallagher ordered anyone who had the photos to delete them, MacNeil said. Gallagher also got in his face and yelled, "If you take me down, I'll take all of you down."
    Navy SEAL Special Operations Chief Craig Miller testified Wednesday that he saw Gallagher stab the ISIS prisoner "on the right side of his neck, toward the jugular vein."
    Miller -- who admitted to posing in a group photo with the body -- said he immediately reported the murder to his superior. Miller testified that Gallagher asked him, "Who's not good with it?" Miller said he told Gallagher that he was not.
    Former Navy SEAL Dylan Dille testified he saw Gallagher pose for individual and group photos with the body of the prisoner, who he described as a frail, weak and injured 12-year-old.
    Dille said Gallagher later told him and the others, "I know you're not alright with what happened, but it's just an ISIS dirtbag. Next time if I get a prisoner, I'll do this where you can't see what happens."

    Witness claims he killed ISIS detainee, not Gallagher

    But the undeniable highlight of the trial's first week came Thursday, when one witness turned the case on its head, claiming he was the one who killed the ISIS prisoner in question.
    Special Warfare Operator 1st Class Corey Scott, a Navy SEAL medic, said he saw Gallagher stab the prisoner under the collarbone. He said he saw no blood.
    But on cross-examination, Scott admitted he killed the prisoner. Someone had already performed a tracheotomy on the prisoner, creating a small incision in his neck and inserting a tube to help him breathe.
    "I suffocated him," Scott said. "I held my thumb over his trach tube until he asphyxiated."
    "Did Gallagher kill this ISIS terrorist?" a defense attorney asked.
    "No," Scott answered.
    Scott suggested it was an act of compassion because he was concerned that the boy -- a prisoner of the Iraqi forces -- would be tortured by the Iraqis.
    Scott had not admitted to asphyxiating the prisoner in previous interviews with investigators and the prosecution but was doing so now since he was testifying under immunity and couldn't be prosecuted, he said. He added he had no desire to see Gallagher go to jail because Gallagher has a wife and family.
    Later, outside court, defense attorney Parlatore told reporters, "Today the truth is starting to come out."
    "Today for the first time somebody went to one of these witnesses and actually asked the question, 'What is the cause of death?'" Parlatore said, surrounded by Gallagher and his family. "And what we learned is Chief Gallagher is not guilty of murder."
    The defense made a motion to dismiss the case based on Scott's testimony, but was denied.
    A Navy spokesman said in a statement that the government would not drop the premeditated murder charge against Gallagher, saying, "the credibility of a witness is for the jury to decide."
    The trial is due to resume Monday morning, when the court expects to hear from Navy SEAL Master Chief Brian Alazzawi, as well as a digital forensics expert and some witnesses from the Naval Criminal Investigative Service, or NCIS.

    From my understanding, CPO Gallagher stabbed the kid while he was being treated for his wounds and then the medic asphyxiated him. Gallagher's intentions were to still kill the kid while he was being treated.

    Aubrey Trail slashes neck in courtroom, shouts 'Bailey is innocent and I curse you all'

    WILBER, Neb. — An already bizarre murder case got even more bizarre Monday as the defendant, Aubrey Trail, apparently attempted to kill himself in court.

    As a trial witness left the stand Monday morning, Trail, suddenly and without warning, shouted and began slashing his neck with what appeared to be a small blade of some kind.

    “Bailey is innocent, and I curse you all,” he yelled, just before rapidly slashing at the right side of his neck.

    Trail crumpled to the ground, with blood visible on his neck, as deputies rushed to grab his weapon. Trail had fallen out of a wheelchair he’s been using during the trial as Saline County deputies grabbed him.

    He appeared pale, his eyes were closed and he wasn’t moving as rescue personnel loaded the 52-year-old defendant into an ambulance for a trip to the hospital. A cleaning crew was dispatched to the courtroom to clean up blood on the floor.

    But one of his defense attorneys said later Monday that Trail was in the process of being released from a hospital and was expected to be in court on Tuesday morning when testimony resumes.

    “We still think we can get a fair trial,” said Ben Murray, a court-appointed attorney from Hebron.

    Saline County District Judge Vicky Johnson ordered that Trail be handcuffed “for obvious reasons” for the rest of the trial.

    Trail and his girlfriend, Bailey Boswell, 24, both face the death penalty if convicted of first-degree murder in the death and dismemberment of Lincoln store clerk Sydney Loofe.

    For what its worth, a lot of the support Chief Gallagher has comes from inside the Naval Special Warfare Command itself. There certainly seems to be some doubt in their minds about the facts of the case-- including doubt on the part of men who were there when the alleged murder took place and who have some information to share about the actions and motivations of his accusers. I think its important to recognize that Chief Gallagher is a man who served eight combat tours, not some stateside POG wearing his uniform to the mall so he can get a discount at Applebee's. At the very least he deserves his day in court and the presumption of innocence.

    Of course he deserves his day in court. Everything I've read has been pretty damning, though. The argument about his subordinates being "millennials" and accusing him of these crimes because he was too tough on them is pretty weak. I don't think these things just come out of thin air. And being a combat veteran doesn't give you a pass on being a shitty human.

    If he is found guilty, I would hope that some of his benefits would be passed on to his wife and kids. I certainly don't believe they should be punished for his actions.

    The “millennials” reportedly built a grudge based on the way the senior members ran the unit— specifically the daytime raids that they deemed too risky. Their initial intention for the complaints was to block a promotion and a medal for Gallagher. When the investigation went beyond that, suddenly nobody wanted to follow through— until they were forced to.

    Without getting into detail that you can read elsewhere, there are no fewer than four versions of what happened to the teenager, including the “practicing” of medical procedures on him by multiple members because he had no chance to survive. Multiple witnesses had Gallagher performing a cric (airway) procedure to try to save him, but then he supposedly stabbed him. Which seems no more likely than the other medic blocking the airway tube. A couple witnesses have all that happening after the kid died.

    The reported sniper kills are also rebutted by witnesses. The defense maintains the case is built on weaving rumors and hearsay about unrelated statements Gallagher supposedly made, none of which is confirmed by more than one person at a a time. I don’t know all the facts either, or what the correct verdict is, but it is far from a slam dunk case.

    You may not want to deny him his day in court, but calling him a piece of shit whose only support comes from toxic troop worshipers sounds like you’ve decided who’s right and who’s wrong. My point is that his sacrifices on the nation’s behalf deserve a little better than that.

    The toxic troop worshiping comment is based on the hordes of people I see on FB/Instagram/whatever social media accounts I follow that are geared towards military/veterans. Way too many people (from my experience) seem to not care about the circumstances of the case but that it's all a moot point because fuck isis/fuck the middle east/fuck millennial snow flakes blah blah blah. I made a innocent comment on an instagram post once about the case and was labeled an isis supporter.

    And from everything I've read i probably have come to an opinion that hes guilty. But I hope he truly isnt. I would like to think that someone isnt just shooting random civilians for the fun of it.

    I’m not going to judge him for a taking a plea. But let’s look at it like this.... he does a false confession. Loses at trial. Goes to prison. Claims he is innocent. Claims he was coerced. Wins his appeal. Time for a new trial. Then he agrees to a NEGOTIATED plea of 35 years or whatever to the murder.

    Yeah, I don't put any stock in accepting that plea. If I were falsely accused of a murder, I'd prolly take a plea cuz fuck no do I trust a prosecuter who's incentivized to get my ass no matter what and a box of twelve random idiots 5-6 of whom prolly voted for Donald Trump to determine my fate. No thanks. I'll just say I did and hopefully get out in time for my 80s

    I keep watching that show hoping that once, just once, one of those law enforcement agents will say "yeah in hindsight, I really coerced that guy and I'll never do it again."

    Very discouraging to see how dug-in cops get. No layer of "what if I'm wrong" thinking in a field where that's prolly a pretty critical attribute.
