After thinking about it a little, Mr. Gugino should sue Trump for libel. He is obviously not a member of Antifa as can be proven by his charitable work and other activism history and Trump’s comment was meant to defame the man. He is also not a public figure simply due to his being the subject of a news story about what happened to him. As such, there is not a heightened standard of actual malice (knowledge of or reckless disregard as to false statement) necessary to prove as only negligence (lack of reasonable care) of the truth is needed, though actual malice might exist.
