You can’t make someone talk if they don’t want to. Especially if that person thinks talking results in a murder charge- you can’t really threaten them with much at that point.

Can they not force him to go to the station to be questioned? I feel like "Na man, I don't feel like talking about it." would suffice for a black guy suspected of murder.

Ftr if your gf goes missing it is the appropriate legal decision to lawyer up and be careful with how you cooperate. Independent of whether you actually killed her.

It's like some of you are new to policing in America.

Because our Constitution says that nobody ever has an obligation to talk to police?

They could ask him to come, voluntarily, but that’s it. Right now there doesn’t appear to be much direct, tangible evidence, at least that the public is aware of. You can’t just detain someone for “questioning” despite what tv and movies suggests.

The answer is likely getting a search warrant for his cell phone and internet history.

If he did it, and he very likely did, there's going to be a mountain of evidence to convict him even if he doesn't talk to them.

Some of you seem like you don't particularly care about Constitutional due process.

The state needing good cause to detain me is far more valuable to me than a random missing woman. Perhaps insensitive but true. Hard pass on the police state some of you seem to desire.

We literally had someone on this very site have the cops try and frame him for a murder he didn't commit.

I get this side of it, obviously, but on the other side, the last person to see his girlfriend alive is not giving *any* information to the very people who might be able to find her. Regardless of his legal rights, that is supremely disturbing.

Yeah, I completely agree that it's a natural reaction for the public to assume guilt when he's refusing to cooperate. It's a horrible look and the lawyer's statement did nothing to help.

It's still the smart way to protect yourself, guilty or not.

No more disturbing than an innocent SO who cooperates with police going to prison thanks to a coerced confession. Which is a thing that happens

Without a doubt. Also, this motherfucker absolutely did it. His actions afterward damn near cement it.

Getting a lawyer is smart. Preserving your legal representation over your missing loved one's whereabouts is telling, in my opinion.

I love my SO. If she went missing I'd be a panicky, desperate mess.

And there's still a 0% chance I'm talking to police without representation. If you're ascribing guilt to a person based on that you're making illogical assumptions. It's unfortunate that the incentive structures create this circumstance but pretending it isn't the case doesn't change it

Person: has his child abducted from his home by an unknown assailant.
Person: hires a lawyer and refuses to speak with anyone.

People are ascribing guilt because he's not talking to the police, not because he got a lawyer

I think the guy is pretty obviously guilty, but no matter what I'm never talking to police without a lawyer present on anything remotely suspicious. I'd talk to the police, but I sure would have representation there the entire time. That's what I would expect a smart innocent person to do.

for the record I’m ascribing guilt because of everything he did before he decided he was going to get a lawyer and not talk to police, like not tell anyone she was missing for a week while he drove 2000 miles in her van

there is a difference between "he lawyered up he must be guilty" and

he drove 2000 miles back to Florida, didn't report her missing for weeks, hired a lawyer and refuses to cooperate in any way with police or her family, he's probably guilty.

Basically all of the circumstances surrounding this disappearance make it pretty clear what happened.

In an alternate reality where he didn't kill her, I'd love to know what would go through this dipshit's mind to respond exactly the way he did. Like, if she just disappeared, or they got in a fight and she walked into the wilderness, or she killed herself, what kind of a fucking moron would respond by driving her car back to Florida, hiring an attorney, and not even calling for help?

Was it her car or their car? I've seen both reported. Regardless, I think he's more than likely responsible for her disappearance. But, there's at least a conceivable possibility that she told him to kick rocks and he didn't perceive her to be "missing" until after her parents reached out to him. That, of course, wouldn't trigger most people to lawyer up, though.
