I drove nearly 2 hours for the start of a trial yesterday. Was about 5 minutes out when I fond out the opposing counsel woke up with COVID symptoms and it was getting continued. Thought that was just a fantastic way to start 2022.
are there still in-person jury trials in AL like nothing's changed? King County, WA just suspended all in-person appearances until March. Oregon hasn't returned to in-person since March 2020.
Jefferson County just renewed an in-court mask mandate, but I'm not aware of anyone canceling trials.
Trials still happening here. But you're much more likely to get continued by a trial judge on last minute notice because of "COVID" than you were pre pandemic. But the verdict reporter is still reporting a decent amount of jury trials.
We took a break for a long time, but yes we’re back at it. In venues where I practice, usually we do jury selection either in batches or large venues with masks, and then jury sits in audience of courtroom during trial. Makes it very weird when questioning witnesses.
Premises case involving a property owner and cleaning/landscaping company. Counsel for the cleaning/landscaping company files a MTD/MSJ before any discovery arguing they had no duties under the service contract. The contract references three schedules which apparently contain duties and expectations. Opposing counsel submits the contract as an exhibit, but wholly omits two of the schedules and omits the first page of the third schedule. Like, what's your plan here? Do you just want the judge to hate you from day one?
Interesting. I too have a premises case involving a landscaping company in litigation right now. Technically mine is a tree removal company but the negligent conduct was essentially landscaping.
Work is starting to pick up again. Looks like I'll be back at full speed by next week. Getting my brain out of relax mode has been difficult.
Did the most fees I've ever done in a year before in 2021 and strangely did more in comp fees than any other practice area. I doubt that ever repeats itself. Usually PI is 3-4 x comp.
I don't know about yall, but I think I'm actually get less done this week than last week or the week before, which I didn't think was possible.
Nothing special. Just back to the regular grind of having 2 depos, a mediation and a depo prep scheduled for the same day and dealing with that. Et cetera.

latest update. They are now claiming my client committed fraud because the son lived in the house instead of the named insured. Something that happens all the time and has never resulted in a win for the insurance company. The OC called me at 4:59 on Friday to give me a "chance" to drop the case before he files a motion for sanctions. Can't wait for the trial on this case.

So have another train case PC but this time its a wrongful death but the dude was just walking across the tracks. Sounds like another one we have to punt on. RIP to the dude but how do you not see /hear/feel a train coming?

Sometimes I hate you defense lawyers. I’ve got a little minor MVA in a decent venue. Total diversity of Parties, so in my complaint I specifically stated that the amount of damages sought by Plaintiff are less than $75,000. Got a notice of removal today—defense lawyer says that since I plead punitives that I can’t say it’s less than $75k.
just got out of a mediation client has 24k in meds defendant is lying about how the wreck happened. we have her depo and took depo of a witness that basically says she is straight up lying. my client is traveling on a frontage road of a highway here. def said in her depo that she was at a stoplight in an underpass and that she saw the second light, on the other side of the underpass turn green, so she rolled out into the interection and hit my client. witness says that she just blew through the intersection. my guys car is basically unrecognizable, he did a 360 and was thrown into a concrete barrier they want to go to trial instead of paying 35k unreal
