does anyone have any fred loya cases? from what i've heard they aren't settling anything, aren't hiring experts, and just trying to string out all of their lit cases thinking they might be running out of $$?
we have a case that's set for may where the two prior defense lawyers were totally incompetent--the first was screaming at a mediator who is one of the more respected mediators in houston who is so popular that he's booked 4 months out. the second one during another mediation was talking about hiring all of these experts and ordering all of these affidavits even though all of his deadlines were blown. called the new lawyer on it, she sounds experienced, and just sort of told her like hey i'm sure this got thrown on your desk, all of your deadlines are way way overdue, and your client's car looks like an accordion. so maybe if you just got thrown 100 files on your desk this might be one to talk to your supervisors to try to settle she was basically just like fuck my life, these aren't my decisions, and yeah i will be the one at the courthouse.
also we are #3 on a two week trial docket that starts a week from to day. defense lawyers were supposed to file and exchange pre trial docs by friday. kind of hope they don't so that we can try to exclude their defense expert
I did defense work for a carrier that wound up going tits up. The not hiring experts thing is a pretty strong indicator that they are headed in that direction.
I've seen a good amount of cases where the carrier didn't hire experts in fields where Plaintiff had experts. Definitely isn't the norm but it happens.
Wait for the right case, send time limit demand, they don't pay limits within demand period, they don't hire experts in areas where they obviously need them, get verdict substantially beyond policy, have insured assign bad faith case to you against his insurer....profit.
That’s the plan. in Texas you can send a “stowers demand” which is basically a demand within the policy limit that a reasonable insurer would pay and if they don’t accept the policy limit goes away
I made the drive again this morning for this trial to start. There aren’t enough jurors who showed up to strike from. If this had happened 5 years ago I might have been disbarred. I’m ab to lose it.

I'm thinking about broaching that topic after this next 2 month stint. Going to play it by ear. It's going pretty perfectly, working like 3-4 hours/day, sometimes 5-6 if there's a lot going on.
When are you thinking about broaching that topic with them? Also, how many hours do you work per day?

I once had counsel from Morgan Lewis in Chicago move to strike my appellee brief for violating page restrictions because I put case citations in footnotes instead of the text. They actually re-wrote my brief with the footnotes in the text to demonstrate my violation, attaching the longer version as an exhibit. Their local counsel did not know that one of the judges on our panel was the author of a manual on writing style, and an advocate for case citations in footnotes. I filed a two page opposition, quoting extensively from this justice’s own learned treatise. Two counsel for other insurers freaked out and re-wrote their briefs, worrying I was being too smug about things. The judge who I cited took the time to write a decision, 171 Ohio App. 3rd 145 (Ohio 1st Dist. 2006), generally agreeing with me (and himself), but told me to use 10 point font next time. https://www.supremecourt.ohio.gov/rod/docs/pdf/1/2006/2006-Ohio-6194.pdf This was like only the second or third reported decision I ever had, and the partner on the case wasn’t too happy with me for being such a smart ass about things.
Depo on Friday Field Adjuster states he disagrees with the coverage determination from the insurance company. Monday- Send email trying to get the case settled because Insurance company has not shot if this goes to trial. Wednesday- Reports come out that the insurance company is going bankrupt and all claims are being sent to FIGA
have a case in may that has gone through 4 different allstate lawyers. the current one hasn't taken a single look at it. i think it could be 7 figures.
*Civil cases. I don't do much criminal work anymore, but I still keep a small book just because I love it. But every time I try a case, my wife asks why on earth I do it when I can't eat and am about to throw up for a few days. She doesn't get that I actually love it.
Obviously Jamail is the goat. I work for someone similar in character and attitude. I enjoy these romanticized biographies as much as anyone and there's a lot of truth in what is written here. But, part of me also wonders how his antics and behavior bit him in the ass over the years. We'll never know, I guess. It's something I struggle with as a young lawyer - how aggressive and hard do you push at the cost of everyone literally despising you versus being the nice guy that everyone thinks is a pussy. It's a tough balance in my opinion.
