    New Supreme Court leaks suggest turmoil and long-held grudges

    The leaks from the Supreme Court about its impending move to strike down Roe v. Wade continue, with Politico reporting that there has been no movement inside the court since the draft opinion authored by Justice Samuel Alito. No conservative justices have shifted position, and no dissents have been circulated within the court, according to sources, while the justices have been rocked by the leak and the ensuing outrage.

    While Chief Justice John Roberts is, according to previous leaks, looking to peel one of the far-far-right justices off to join him in a ruling slashing Roe’s abortion rights by upholding Mississippi’s 15-week abortion ban but falling short of the no-holds-barred destruction of all abortion rights in the Alito draft, he’s apparently not succeeding. Part of that, one of Politico’s sources suggested, is coming out of a longstanding grudge on the court.

    Roberts was the deciding vote in upholding the Affordable Care Act, and he reportedly switched positions just days before the decision was announced, infuriating his fellow conservatives. According to “an attorney close to several conservative justices,” the resentment lingers: “There is a price to be paid for what he did. Everybody remembers it.”

    Conservative law professor Jonathan Adler also notes that ongoing resentment, while suggesting that the latest leak to Politico “leaves open the possibility that especially after the leak, draft opinions are being held more closely. So stuff could be happening behind the scenes,” and noting that in some major past cases—including the Affordable Care Act one—“the ultimate coalitions were forged privately, and surprised some of the other justices.”

    If a decision about how dramatically to overturn 50 years of abortion rights in 2022 is being affected by a decision about the constitutionality of a health care law in 2012, the Supreme Court—and specifically its right-wing justices—is doing a really good job discrediting itself as an institution and making the case for reform.

    There’s an internal investigation into the leak of Alito’s draft opinion, but here’s an important point:


    Whatever is going on over there, the Supreme Court is a mess in ways transcending its Trump-McConnell stacking and extremism. Unfortunately, reproductive rights for millions of people are what’s on the line in the current infighting and strategic leaking.

    So Alito and Thomas are still butthurt about the 2012 ACA decision and are being even bigger dickbags than usual? They're the only other conservative justices who were on the court for the ACA decision, right?

    Have we talked about the part where we are in the middle of a formula shortage because a big corporation was, shockingly, worried about profits while we are in the middle of people saying, ‘just put them up for adoption!’ as if those people can just throw out a boob to feed said baby? they adopt.

    (Nevermind the fact that not every mother can just ‘breastfeed’ for a HUGE fucking list of reasons that’s even longer now and has ALWAYS been an issue since forever)

    A quick Google search shows,

    1- Medical literature first talked about what would become much later known as gender dysphoria in the mid 19th century, but it was treated as a perversion until the 1950’s,

    2- the first gender reassignment surgery was performed in 1952,

    3- the concept of gender was advocated for by researchers in 1957, and

    4- the term gender identity was coined in 1964.

    It looks like it may be just his opinion and not that of the SC. Hopefully.

    I just don't see it in real life, man. I don't see anywhere making gay marriage illegal and it being okay with their constituents. I'm pretty pro-states, but I would sincerely hope that Congress passes some kind of legislation allowing gay marriage in all 50 states and territories. Hell, I'd say its protected under the first amendment under freedom of association. You're not going to get much pushback from me on that. Marry who you want and enjoy the tax benefits from it.

    I was obviously wrong in my initial post and I hope that Alito's stance isn't based on the merits of gay marriage rather the application of the law. Luckily, it seems like he doesn't have much support on the court in this regard.

    I sincerely hope that nowhere in the United States there is a place where gay people can't be married....ever. If it's through laws or a SC ruling, I don't care. There is enough basis in context and popular opinion to make it happen in either way. If somewhere actually denies this right to people, I'll share in the outrage. I sure as shit won't vote for anyone in SC that holds that political opinion.

    The current governor of Texas, a purple state if everyone could vote, has been actively trying to undermine the decision since it happened. Very very publicly. It would be gone in a week in Texas

    I wouldn't vote for Greg Abbot in Texas. I'm not that far to the right, contrary to popular belief on this board.

    Luckily, it doesn't seem like Alito has a majority on this, at least if he's in contention with Gorsuch on the issue.

    If that's the case, I hope that the federal government intervenes. Like I said, there is constitutional basis for it in the courts and popular support for hopefully bipartisan congressional legislation to make it law.

    Look y'all. There are plenty of issues for us to disagree and argue on. This ain't the one.

    My mistake before in regards to Alito and I guess Texas. Hopefully it never gets to that point.
