Evidence needs to be more probative than prejudicial. You can establish he was a philanderer without showing blown-up dick pics to the jury.
As a general rule, any time an appellate court sides with the accused over the prosecutors, the prosecutors really fucked up.

there was a really good longform article posted on here years ago about the act of accidentally leaving children in cars and how stress rewiring our brains is why and the ethics of charging for murder and stuff like that. may have been based on this case one of the researchers who studied it was kind of iffy on these things being an accident and then he caught himself forgetting his kid was in the car one day and it caused some self reflection iirc pretty interesting article someone link it pls
I definitely read this several years ago. It was very long but a good read that stuck with me. I have a lot of sympathy for parents that have done something like this to their kid by mistake. I just think this particular guy fucking did it on purpose.

This is not really the same but there were years where I had to pick up a kid from preschool midday a couple times a week. Because it wasn’t every day and was outside my normal schedule, I forgot once. Got a call about 45 minutes after I was supposed to be there after I’d been doing it for several months of the year. Child hot car not a great analog but forgetting things outside of normal circumstances because it’s not your habit or you’re a corporate drone going through the motions is at least plausible to me.
That's how the prosecution postured it to the news, but it's not at all what the evidence presented showed. They had both searched something vaguely similar, and in the week or so prior he'd clicked on a trending video on reddit about pets being left in cars.
The guy was definitely a dirtbag, but a lot of the narrative has been really blown out of proportion. I remember reading that he had "massive credit card debt" and it turned out to be something like $4k.
I think I told this story here in the original thread or somewhere on this board… I had a friend I used to play poker with in my early 20’s that worked with my mom several years prior. He was in his early 40’s and he and his wife had a few kids, and a new born son. He worked for Walmart ISD and stopped coming to the monthly poker tournaments because he was having to work like 90 hours a week in the summer of 2010. He dropped one kid off at one of their daycares buildings, and their youngest was supposed to be dropped off at the daycare just down from the other one which was right across the street from his work. He unfortunately went straight to work and left their youngest in the back seat. I think he got a call from his wife who got a call from the daycare wondering where the child was around noon. He panicked and ran out to his car and found his child and tried to take it to the daycare. The child wasn’t breathing and was taken to the hospital where it was pronounced dead. I'm new to this case, so anybody who followed it the first time or since, what was the father's explanation for not seeing the kid when he went to the car during lunch? the phenomena of accidentally forgetting a child in the back seat is so horrifying. I've seen where some safety and health organizations teach parents to keep their phone, purse, shoe etc. in the back seat when transporting a small child.
I have a backseat warning on my vehicle that prompts you to check the back when you get out. It's annoying as hell, but I keep it on just to be safe. I used to keep my briefcase in my backseat for the same reason.
