Do you just not understand what “using the 14th amendment means”? Also, have you read the 9th amendment? It doesn’t have to be explicitly stated in the constitution for it to be a constitutionally protected, god-given right. That’s the entire point. We have the right to privacy, but that right isn’t explicitly stated in the constitution. You have a constitutional right to self-determination even though that isn’t explicitly stated in the document either. Abortion is an act that sits square at the junction of those two constitutionally protected rights. As such, it also is. Or rather was, until 5 absolutely insane, unelected, unaccountable assholes stole that right from you.
That's not what I'm saying at all. Roe v. Wade isn't legislation yet it attempts to make legislative decisions as to what legal abortion is without labeling it as a constitutional right. It uses the 14th amendment as the basis under a right to privacy (which is an interpretation of the 14th in itself) to provide for a trimester based framework for legal abortion. Hell, it says that after 12 weeks, abortion should be " narrowly tailored" to protecting mothers' health. Again, its ambiguous and it makes a decision that the court shouldn't have purview over in the first place. I'm generally pro-choice. We need our law makers to make laws allowing for safe and legal abortions with appropriate limits.
