I don't think that the fact that "we could see it coming" is relevant to the severity of the ruling. Please correct me if I am wrong here, because I don't follow this as closely as others itt, but doesn't the ruling essentially gut the EPA's ability to regulate climate change without the express, completely unambiguous consent of a completely feckless Congress? Given that this is a crisis that affects every living thing on the planet, and how impossible it is for Congress to act on anything, this seems very bad to me.
I think that’s a fair read and I agree that it’s an awful result. I’m just saying that, as bad as it is, it could have been a lot worse. Dobbs is an example of the point I’m trying to make; Roberts agreed with the the decision to uphold Mississippi’s abortion restrictions. That’s bad, and exemplary of his tact of taking the minimally necessary step to achieve the result he wants. Five justices went further and killed Roe/Casey, and brought a whole different line of substantive due process cases into question. Clearly a much worse result.
Both Thomas and Alito have are OAN/Newsmax conservatives. Add in the total psycho Amy Coney Barrett and a full third of the SC are are at the whims of Russian bots.
What's the point of even having elected officials when a cabal of religious clerics decides on every aspect of law?
This is the one where basically a state can decide the outcome of a federal election regardless of the outcome of the votes?
I’m not sure what any of you expected when it comes to Thomas his dumbass wife was a part of the terrorists on Jan 6th
If Republicans begin just handing out electoral votes regardless of actual election results, I can only assume their goal at that point would be the total dissolution of the United States.
We're down to months before they kill democracy and we won't hear a peep about court expansion. So fucked.
This is their path to minority rule. The electoral college and the senate being equal representation for states were mistakes. No other way to put it. The SC having lifetime appointments was a mistake. The SC being nominated by a partisan politician was a mistake. McConnel and the gang are exposing all of those mistakes and using them to his favor to take over the country with minority rule. And the Dems are sitting back and watching it happen.
We can impeach him. But we need 10-12 republican senators to be on board with not having a conspiracy theorist on the Court. But the populace up to this point either gives the current republicans a pass, or points the finger at democrats.
Decent starting point for Moore v Harper and the “independent state legislature” doctrine being argued This is a real boon for all the attorneys, state lawmakers, and other pieces of shit who all make up the “stop the steal” ecosystem. I hate these people so much.
I legitimately will start yelling like this if I start ranting to my wife about what a shithole this country is. Loved Augie so much
fun! North Carolina law provides that lawsuits challenging “any act of the General Assembly that apportions or redistricts State legislative or congressional districts” may be filed “in the Superior Court of Wake County and shall be heard and determined by a three‑judge panel.” This court’s decision may then be appealed to the state supreme court. Indeed, North Carolina’s laws — again, laws that were written by the state legislature — provide detailed instructions on how state courts should behave when they determine that a legislative map is illegal. One statute requires state courts to “find with specificity all facts supporting” its conclusion that a map is illegal. Another provides that, after a state court strikes down a redistricting plan, it may not “impose its own substitute plan unless the court first gives the General Assembly a period of time to remedy any defects identified by the court.” In its eagerness to hear an independent state legislature doctrine case, in other words, the Supreme Court appears to have taken up a case where there is no legitimate legal conflict. Even if state legislatures have exclusive authority to shape a state’s election law, the North Carolina state legislature used this authority to explicitly empower state courts to strike down gerrymandered maps. And yet, it’s hard to imagine why the Court would agree to hear this case unless it is at least considering rolling back decisions like Davis and Arizona State Legislature.
but Biden doesn't want people to think the Court is illegitimate as it enshrines into law unpopular conservative policy every other day.
"At this point we should be well beyond partisanship." She's right. Another annoying red herring is saying that America is just so divided. How about one party is pushing anti-democratic policies at all levels, including the attempted violent overthrow of our govt.
Legitimately someone will have to dome one of these filibuster supporters for this shit to finally crack. I'm losing my fucking mind right now.
Heard speculation this morning (Morning Joe I think) that maybe we can get 2 more senators and hopefully overcome the Manchin/Sinema problem. If that happened, I'd be very surprised if another asshole didn't come out from behind their coattails to also reject changing the filibuster.
which is why the Dems opting to do absolutely nothing has to put even the most ardent of the “they’re not complicit, they’re incompetent” folks on notice
I’m just pissed at the media for failing to adequately describe any of this shit happening. The Supreme Court has made itself a dictatorial body and left violence as the only tool with which the majority of Americans can protect their rights. Just a gigantic L for the entire concept of liberalism
ummm well actually this is a republic not a democracy so all this minority rule shit is good and normal and people still expect me to think the US governmental structure is good
Most of our elected officials won't do shit because they're capitalist pigs, and any disruption might negatively affect their beloved stock margins and such. As for the rabble, what's needed is this (see thread below), but at least for now, we won't see it, because there's this still this false illusion that we still live in a viable, functioning democracy.
It’s shit. The Swiss are on to something with direct democracy, and chocolate, and cheese. Just have to get rid of their xenophobia and FIFA and it might be a nice place to live.
Hope none of y'all live anywhere close to an Iowa pig farm https://www.washingtonpost.com/busi...5dfb32-f89e-11ec-81db-ac07a394a86b_story.html The Iowa Supreme Court on Thursday reversed a long-standing precedent that allowed landowners to sue for damages when a neighboring hog farm causes water pollution or odor problems that affect quality of life. The court concluded, 4-3, that a 2004 decision was wrong.
Anyone owning land adjacent to an Iowa hog farm is also polluting the waterways, just in a different manner. Source: I’m related to Iowa DNR waterway pollution investigation and enforcement guys.
