Ehhh I don't think it's that simple. Some people just prefer to not take a lunch break. I'd much rather work 9-5 and get home to my wife and kid than 9-6 with a forced hour break where I'll do nothing but play on my phone. I'm salaried and I very rarely take a lunch break. I'd rather not waste an hour mid day. That's an hour I can spend at home with my kid at night.
This further proves my point. The lawsuits from employees weren’t bc of “wahhhhh I couldn’t take my lunch break.” They came from the anger and frustration of being worked to fucking death by a company that could give a fuck about them, and this is one of the few avenues they could convince courts or lawmakers to side with them in their fight for employee rights. Even if the policies companies create to safeguard themselves from those lawsuits affects you, it doesn’t change the reasons they were originally put in place.

If you want a lunch, you should be able to do that. If you don't, you should have that option too.
I wasn’t given that option at old job. It was 7-4 whether I took a lunch or not. 95% of the time everyone took their hour lunch unless there was some emergency/urgent work.
Ahh I see it changed. We're a Cali based company and I remember it being a topic on several confernce calls about employees wanting to skip lunch and HR said they couldn't. The employer also still has the right to set your schedule, so if they want you there at 5:15, they can set your schedule as 9-5:30 with a 30 minute break. And lazy companies like some former employers referenced by certain bootlicking posters who don’t want to deal with compliance might do that instead of obtaining sufficient consent to break waivers.
But you understand that what led to people now HAVING to clock out of your shift is way more complicated and that you being required to take your break is an acceptable con to a pro of imperfect laws that protect workers rights, correct? Im sorry I’m not a professional thesis writer dbl and that I’m not going write a however many pages long post to accurately describe the mindset of every single worker. But you need to understand that the these laws and company policies were’nt created to prevent you from going home earlier to spend more more time with your wife, kids, and shoes.
Yea I get it in some situations like line workers or call centers where they need X amount on phones to answer calls at all times. Now that other employees have the option to waive it, I think it works well for everyone.
I get that, but up until the recent court case, some people were being forced to take a lunch when they didn't want to. Does that con outweigh the pro of people that previously wanted a lunch but wanted one being forced to work through it? Of course not. But at least it was recognized that a group was being screwed and it seems to be corrected. As currently constructed, I think it's good for everyone.
At a previous job when I controlled my my office hours, I always passed up on lunch hour so I could go in at 10 am instead of 9. If I packed my lunch, I'd always just sit at my desk dicking around on the internet so figured I might as well just work and eat and be there less. I'd gladly do the same thing now if it weren't for the fact I had to be here from 7:30-4, or 7:30-12 on Fridays, and was thus required to take my lunch unless I got permission to work thru it.
