What’s more likely- a clerk who likely has limited global understanding of how the dominos may fall if they release the brief, and risk their entire career OR a justice that does fully understand those implications and self-awareness that they’re above the rules with no realistic risk of punishment
Alito leaked the result of the hobby lobby Obamacare decision at some dinner party. There’s absolutely no way he kept his mouth shut for something as monumental as overturning Roe.
Supreme Court marshal says she “spoke with each of the justices” during the investigation into the leak but “did not believe that it was necessary to ask the Justices to sign sworn affidavits.”
Yet another ethics scandal has rocked the Supreme Court, raising even more questions about the basic integrity and independence of the institution.1 First, The New York Times uncovered a "donations for access" scandal involving a Supreme Court-affiliated charity that raised millions from anti-abortion, anti-LGBTQ+, and other right-wing and corporate interests. Now, we've learned that the wife of Chief Justice John Roberts, Jane Roberts, has been paid millions of dollars in commissions by law firms with dozens of cases before the court. One of the firms that paid her had argued 125 times before the Supreme Court.1 Here's the kicker: Because the Supreme Court has no legally binding code of ethics, not one dime of these payments were even disclosed to the public. We only know about it because a former coworker of Roberts' came forward.
Honestly having the courts strike this down *may* incentivize Biden to continue the pause, and be a net positive. The longer interest accumulation is on hold, the better chance it gives folks to save up. $10k forgiveness helps many people, our current pause status helps everyone. I’m saying this under the assumption that he’d still pursue loan forgiveness to some degree in a different manner. If SCOTUS shoots this down, and Biden shrugs and does nothing, that’s obviously a terrible outcome.
It would cripple the government. Wouldn’t this open the door to literally sue the government for any spending you don’t agree with???
The public health emergency is slated to end May 11th. The ship has a planned departure, but that can’t stop the shipping company from delaying that departure either. Here’s a good thread to follow along with arguments
pretty sure they have made representations about this really being the end date in the context of the Title 42 border cases - I don’t think they have a realistic pathway to reversing course on it
I'm no legal expert, but isn't the Major Questions Doctrine just made up by the conservative court and not founded in any constitutional basis?
I think it became firmly “established” in the last couple of years- I forget if it was an EPA or 2nd amendment case
Arguments are done and the case has been submitted. It was fun listening, though I only caught the last 15 minutes or so. KBJ did very well with her questions from the little I heard.
Haven't people literally had their loans forgiven already? Does Roberts think they would just reinstate the loans and start charging again?
Reminder if they strike down this method they'll just do case by case reviews to get to the same result
Sounds exactly like something an uber-conservative SCOTUS would allow to happen, in which such a precedent would only be taken advantage of when a Democrat is in charge.
From the little I heard, ACB seemed to really question the standing issue. I’d almost go as far as to say it sounded like she leaned against the argument that was being made.
Just reading this is funny tbh. If the federal govt doesn't have control over federal student loans, who the fuck does?
Roberts speaking of modifying the French nobility like five posts after a story about his wife getting millions from lobbyists is pretty cool.
That's the best argument in favor of the program going forward. The HEROES act is a little weak for justification IMO, but I don't see how any of the Plaintiffs have standing.
For people who think McConnell isn’t the goat… this is exactly what he wanted. A group of partisan dickheads deciding shit for 300m+ people and no consequences as just making it up as they go along
That's such bullshit. They saw the national disdain and didn't give a fuck. They could have changed their vote if they did.
