Breaking news!!! I think it is more incumbent on law enforcement to be proactive in not escalating situations. Cops are trained to handle idiots. Idiots aren’t trained to handle cops.
This is a weird take. The woman locked herself in her car and refused to do a simple task, but the cop is at fault for “escalating” the situation. Got it.
You may not practice criminal law so I understand the disconnect. If someone refuses to sign a traffic citation the next appropriate step for law enforcement is not to place them under arrest. When he said “step out of the car you’re under arrest”, it escalated the situation. He should have told her the signature is just an acknowledgment that she got notice of the hearing and not an admission of guilt. Her window was still open and he could have given the ticket without the signature and went on his way. He has proof she got it through cam footage.
wtf? The signature is required to confirm the violator understands they are required to appear before the judge to either admit guilt, or challenge the ticket. You are basically arguing she shouldn't have been cited. Refusing to sign a violation is grounds for arrest. If you don't agree with it, change the law.
Here is a good summary of the situation which I feel contradicts your perspective. The traffic ticket contains an actual notice to you of a pending court date at which you must appear. By signing the ticket, you are providing an acknowledgment of receipt of the "notice to appear." Since the officer is charging you with a violation of law, he could take you into custody. By signing the traffic ticket, you avoid being taken into custody at that time, and are "released on your own recognizance" pending the court date. It is better to sign the traffic ticket and go about your business pending the court date. By signing the traffic ticket, you remain free and retain the right to show up at the hearing to contest the issuance of the citation or summons. A person is free to refuse to sign the traffic ticket; however, the police officer is free to place him/her under arrest and take him/her into custody. While I agree, the camera could be a confirmation she has received the ticket, if the camera had malfunctioned with out the officers knowledge, this evidence would be unavailable and the ticket signature would not be available in your situation. Team Cop.
Idk if that is the law in each state. Idk where you got that from. If it had a code cite specific to the state that she was arrested in it would be more well received. However, the fact that the cop decided to place her under arrest for something as minor as refusing to sign the notice hat she received the ticket should not be grounds for arrest, even if it is permitted. It’s a case bay case scenario. It’s my opinion that she is an absolute idiot and she deserved what she got for being an idiot and not following the law. I see it also as a police officer who didn’t need to escalate the situation and could have let the judge dealt with it at the court date. Dude went to her window with his gun drawn down on her. Team neither of them.
I agree the gun was unnecessary, but at this point it is a felony stop. Most department policies are in a full felony stop, you exit the vehicle with your weapon drawn. As I said before, if you don't like the law, change the law. I believe in Oklahoma, refusal to sign a citation is grounds for an arrest. Similar to the fact of refusing a BAC measurement results in a suspension of the drivers license regardless of the result of the incident. The woman was behaving as an entitled individual who the laws did not apply to. She refused to sign as she did not agree with the citation. She made the decision to flee which put the public and the officers safety along with her safety at risk. If people would like to modify the statute which removes the requirement to sign a citation provided by law enforcement, the public is free to do that. As posted elsewhere, for my protection, I would like my signature required on any moving vehicle citations to ensure I am notified of any citations.
