Just took a defense expert depo and it was like his second time he provided a Medicare fee schedule and said it wasn’t medicate but just the National fee schedule and said he would provide mike 10+ documents he relied on but didn’t give us with his report I think he might be getting struck
In Texas, if the expert is retained or controlled by a party, that party is obligated to provide that information.

So, client owns a towing company and has a garage policy. He’s hit by a drunk driver while on call. Twist is he was doing contract work for another tow company and was in one of their vehicles. So question, does my driver’s UM coverage on his garage policy cover him while in another tower’s auto?
Look at the policy language, but generally UM/UIM follows the driver. Vehicle UM/UIM would be primary and garage policy would be secondary.

I hope that douchebag loses his license. I’ve dealt with people who operate similarly to that (albeit not in writing, unfortunately). There’s no room for that kind of behavior in this profession and people who behave like that don’t need to make life miserable for the rest of us, regardless of what side of the bar they represent.
