I don't think anyone should be responsible for what someone else does.

We've gone around in circles. I've think I've made my point. If you disagree, that's fine.

I think someone acting in a responsible manner is much likelier assumption if they aren't absolutely sloshed. People do dumb shit when they are wasted. I wouldn't say it's the seller's fault but at some point you probably should feel some sense of responsibility to not let someone get to the point of being totally incapable of rational decisions. I'm not talking about people getting a buzz and having a good time. You can be drunk and still have your wits about you.

Plus it's just a good idea for business in general. Nobody wants to be around sloppy drunk people, especially the sober staff. They are gonna annoy customers, staff, and will likely forget to tip.

    It’s not really fine.

And from the way I’ve seen other people treat you, it seems like youre pretty consistently belligerently short sighted.

I think you’d find yourself in a lot less “talking in circles” disagreements. If instead of immediately jamming your fingers on the keypad, you took 24 hrs to think about how you feel about a situation. You draw this lines in the ground based solely on how you feel, and every thought after that is how to justify that feeling bc you immediately barf your feeling on the matter online and people with more experience or knowledge on the matter insult you for it. You then go on the defense and try to prove your intellect by boiling situations down to the most simplistic logic model that fits your feelings.

Like just take some time and think your feelings out for once.

Right, I get it from business standpoint and from just wanting to be a good person and help someone get home. I don't agree with a bartender being legally responsible for someone getting in a wreck when they leave.

I spent almost 15 years in the alcohol industry. This isn't a subject I just thought about for the first time yesterday. Lol at all of the assumptions you made in your post.

We talk in circles bc you're not going to change my opinion. I'm not going to change yours.

this is disingenuous and you know it. Most people that walk into a store and buy a case aren’t picking it up to drink it all at once or alone. I bought a case and it’s taken me a month to finish. Generally in a bar you know how much a person (or have a good idea) when I buy a bottle or some beer at a store the individual doesn’t know how much I’m going to drink at once. You’re not arguing in good faith.

When you say charged, do you mean criminally? If there’s civil liability for a bartender, that’s unique to California.

Retraction - can be charged for serving a minor but not for over serving resulting in later consequence.

Imagine you, or someone you know, or really anyone gets mangled, obliterated, or burns alive kicking and screaming in their car bc some drunk fuck in a F150 barreled into them at breakneck speeds.

Then you find out the bar they left had 3 other people leave wildly intoxicated and caused an accident or got arrested.

Then you find out the bartender was just serving everyone, anything they wanted, as long as they were capable of speaking.

Then you find out the bartender is 24 year old dbl. and when confronted outside a sneaker store with three bags of brand new jordans, you find out the only thing running through his big bag of shit brains when serving people whatever they fuck they asked for was:

“how me bad serving customer drink. Me think everyone smart smart Uber home. Me not fault”

Like you all get why there needs to be some kind of law against bars and bartenders to prevent some dumbasses like dbl from serving some drunk assholes some of the time right?

Irresponsible operators are held accountable for any failings in these instances and their licenses are pulled immediately by the state in addition to huge restrictions from the city.

Bartenders and servers literally know their job is on the line if they act in a way that endangers a customer.

Yes exactly bc there are laws in place that I was constantly reminded of when hired or had to retake my safe serve or whatever.

My post was imagining that there were no such laws and the only thing running through bartender dbl’s dumb fucking face when over serving someone is “well shucks I just assume they’ll get an Uber”.

Like that mindset is exactly why the laws that are in place are in place.

But the person at the store knows that you could drink 30 beers. Isn't liability about knowing what could happen not necessarily what did happen?

No, there is no principle in the law that you’re liable for everything that could happen. Every car
manufacturer (among any number of other industries) would be bankrupt if that were the case.

All it really comes down to is that any establishment, be it a grocery store, gas station, or bar, isn't legally supposed to serve alcohol to someone who is clearly intoxicated to the point of not being able to make a sound decision.
