    From what I saw from that article, his previous charge history is:

    Weed possession
    Weed possession
    Got in a fight in 1999
    Weed possession

    Think he did time for all those possession charges.

    Wanna know how to take a non-violent person and make them a violent person? Incarcerate them.

    This dude sucks and should pay the massive price for this unimaginable act. And Wisconsin sucks ass and their shit-tier fat idiot criminal justice system helped make him the POS he is by throwing him in jail for weed.

    It might depend on who tried to stop him initially. I don’t know how it is up there, but I don’t think the Atlanta police can pursue, but the Georgia state patrol can. Someone may have attempted a stop and he fled immediately.

    No, I made a good point period.

    Prior arrests for possession of marijuana isn't going to get you either a no bail or super high bail on a bunch of misdemeanor charges in any jurisdiction. It's a stupid talking point.

    The only possible argument for a higher bond is the bail jumping charge, considering the sole purpose of bail is to ensure your presence in court.

    Online court records showed a person named Darrell Brooks, with a birthdate making him 39, has two open criminal cases in Milwaukee County. In one case, filed Nov. 5, he is charged with resisting or obstructing an officer, reckless homicide, disorderly conduct, bail jumping and battery. Records show $1,000 bond was posted on Friday.

    In the other case, filed in July 2020, Brooks is charged with reckless endangering and illegal possession of a firearm.

    Yes that's why this information is so interesting. If the police were actively chasing him, they are jointly responsible for this tragedy. If the police just responded to the incident and the suspect fled without being chased, it's hard to blame them for the tragedy.

    The only one of those that I would expect a higher bond is reckless homicide, but even then you are entitled to be out on bond.

    The bond discussion is dumb as shit for a number of reasons. The first being that he would’ve been denied bond in exactly zero jurisdictions nationwide.

    Cash bond should be ended, even though this guy has no regard for human life.

    This was the charge that I thought I read earlier, but people haven't been mentioning. Weed charges...gtfo . But Domestic Abuse and I don't feel as bad.

    When they say what bond is, is that the amount you have to pay or do you have to pay 10%?

    I had to bail a friend out of jail one time and they said bail was $15,000. I went there with the money and they only wanted $1,500 which was a nice suprise. So now i'm always confused on the amount people report.

    I don't even know if there is a reckless homicide charge previously, your post was the first I've seen of it.

    Also, what was the $1,000 bond? Was it a $1,000 cash bond? If so, that's the equivalent of a $10,000 surety bond, or was it a $1,000 surety? And even if it was a $1,000 surety bond, how would a $15,000 bond be any more "safe?"

    10% is if the bond is a surety bond and you are hiring a bail bondsman. The bondsman in that case would have to pay the entire $15,000 (which they expect to get back at the end of the case). The 10% ($1,500) you pay them is their "fee" and how they make a living.

    There may be some nuance for what it entailed but yea that one I would assume is more egregious than a weed possession charge.

    Yes, if he's convicted.

    You have a presumption of innocence in this country, and you are only to be denied bond if there is evidence that you are either a flight risk or a danger to the community at large. Bond is explicitly not designed to punish.

    In my mind it would matter the most because there would at least be some evidence of flight risk. But, you've got to know the facts. Even then, I'd expect a low bond. I just might expect a judge to deny bond for a couple of weeks to send a message.

    Friendly reminder that at its base, bail is designed to ensure the accused returns for their court dates.

    Some states utilize it in the event the accused poses a danger to the community.

    Both instances can be heavily influenced by prejudice and racism.

    It is also a tool to punish low income defendants - if two people are charged with the same crime and one has the means of posting bail, then it voids the premise it is designed to protect the community.

    Until we live in a utopia, you need it for certain offenses. I have no problem with a system where cash bail/bond can only be imposed for violent offenses and subsequent felony offenses that are non-violent

    Each jurisdiction has different rules obviously but in my experience - If you have a surety and person flees, the negative impact of bail falls on an individual who is not the defendant.

    Sure, but: (a) that's a business they chose to enter, knowing the risk; and (b) they have recourse/incentive to keep tabs on the Defendant. If the Defendant doesn't comply with them, they can always come off the bond. That's not a particularly good argument for a cash bond system.

    The whole bond process sucks. Either you need to be held or you don't. How much money you can pay shouldn't be a factor.

    It is still unfairly punitive to the poor. Financial means of the Defendant should have zero bearing on ability to secure pretrial release from jail.

    Depends. If you go through bail bonds service you just pay the 10% up front and they cover the rest back and you pay them back and they make sure you show up to court. If you have the money though you can just pay the $1,000 up front and be done with it.
    Edit; if you pay everything up front you won’t have any court costs or anything either. Always heard that judges like to see where a defendant pays everything up front so it’s less likely for them not to pay the remaining balance and end up back in court multiple times.

    if you eliminate cash bail for misdemeanors and lower lever felonies, you are eliminating bail amounts that would disproportionately effect lower income classes

    My friend was arrested for disorderly conduct at a golf tournament we got too drunk at. Cops harassed us, but I complied and did what they said (I got a disturbing the peace charge. I mailed in the money they said I owed and just moved on. Then a month later I got the check returned saying they dropped my charges). My friend was more dismissive and they threw him to the ground so he got pissed off. Ended up spitting on a cop and sent to jail. Does this mean my friend hired a bondsman to pay the other 90%? Not trying to de-rail, but I've always wondered.

    Poor people don't have an extra $1,000 to get out of jail while awaiting trial. Rich/middle class people can. I read his message as in it's a bad thing, but I think he meant that's why we shouldn't have bail in the first place.

    Possibly or he could have just paid it all upfront. I don’t think you can just pay the 10% and get out. Pretty sure you have to go through bondsman to get the 10% discount because they cover the remainder. I move never heard of just being able to pay the 10% yourself, or a friend/family member, and getting out on bond. Some things are just signature bonds like public intoxication

    It’s why a lot of people just stay in jail until their court day. You get time served and if you get to go work it goes towards your fines.

    All criminal charges and their subsequent bail disproportionately effect lower income classes.

    If two people are accused of the same violent crime, and bail is set, how is the community protected if one is able to post bail but the other isn’t?

    Does someone with money offer a lower chance of reoffending compared to someone without money? If not, then the use of cash bail to protect the community doesn’t really work.

    Maybe that's what I did. It was the morning after our event, so I wasn't all there. I do know i went to the jail because I went in and paid and then sat in the parking lot for him to come out. Only to see him walk out with his grandparents and go home with them. He said thank god I paid because they only had $200 and banks were closed on Sundays. Fucker didn't realize I was waiting for him.

    Why could you not have the same amount but allow it to be a surety?

    When I first started my practice, to help get going, I did a lot of indigent criminal work in deprived rural counties. I almost never saw cash bail requirements.

    This is true. I mentioned it above and I have no idea if it’s an actual thing or not but I’ve always heard if you can pay your bail in full upfront then they tend to go lighter on your sentence because you’ve already paid your fine basically and that’s really all they want because of the overcrowding in jails. Always heard you’re more likely to just get community service than jail time depending on the crime of course if you just pay in advance, which unfortunately poor people can’t do.

    Yeah. This thread went the usual way.

    Step 1: make a bunch of rash statements before more solid info comes out.
    Step 2: talk about how much of a POS this person is.
    Step 3: play the race/political card. (If he’s white, he’s a domestic terrorist. If he’s black, he was just wronged by the system somehow).
    Step 4: actual information about the events and the criminal are released.
    Step 5: those jump-to-conclusion posters come back and apologize (just kidding)
    Step 6: shift blame to someone else or something else that has minor impact on this actual event.

    The Bail Bond conversation has been interesting.

    And I’m not trying to grind axe, or declare myself some enlightened centrist. I’ve seen a push from the right say he’s a domestic terrorist because of his Facebook, and I’ve seen people say he was chased into the parade by the police.

    I dunno, maybe it was a bad morning from me?
