I’m just trying to figure out what the gun was going to do other than kill someone. He wasn’t even really being that loud or crazy until the gun was brought out. Then he got in the guys face and started getting more agitated. It completely escalated the situation.
You're missing the distinction. His defense isn't valid, even under the current system (which is *already* designed to give the absolute maximum possible leeway) . He's getting away with it because the people in charge of the system are being deliberately corrupt about it.

A DA with some balls would charge this mother fucker for murder. In Texas however, this is what those in charge want America to look / be like. That video, the Rittenhouse situation and everything else is their wet dream.
The DA recused herself. Another office very easily could be seeking an indictment. Grand jury proceedings are confidential, so there’s no way to know. I think there’s a strong chance charges are brought now that the video is out. The Rittenhouse case is totally irrelevant. It’s a different statute.

The case was referred to the Texas AG a week ago following the Lubbock DA’s recusal. What I don’t know is whether the AG now handles the case, or if they refer it to another county’s DA. I’m very skeptical the AG would prosecute a case seen as limiting gun rights or “castle doctrine” laws. But if they refer the case, my wife’s uncle is DA in a nearby county, I wonder if there’s any chance he could land it. I’m not sure what he’d do, but he’s a reasonable person, and extremely intelligent.
And I first saw this on my newsfeed only a few days ago, I apparently have some Facebook friends who know the deceased. It’s incredibly fucked up; I had a conversation with my wife about how this is the logical progression of the obsession with gun rights at the expense of human lives. We’re now at the point where actual murders are preserved on film for all to see, but half the country thinks it proves murder, and half the country thinks it satisfies this stupid legal dance that we’ve created to allow people to kill other people without repercussion in the name of “gun rights.”
