We have a passive call out policy where we rotate who is on call, don't get paid for being on call, but are expected to make sure we answer in a timely fashion or else. I've been told by my sup that they can't make us come in because it is passive but it will reflect poorly on our performance review and bonus at the end of the year if we don't. Coworker was called out last night. Got the call at 6 and ended up back home at 11:30. That is, by company call out policy, 5.5 hours; from the time you get the call to when you end up back home. He lives about 30 minutes away and ended up texting his supervisor that he would be 30 minutes late this morning because he overslept a bit due to getting to bed late last night. Supervisor makes him charge 30 minutes of PTO. This is definitely a new thing because guys have come in late before after being called out the previous night and not been forced to take PTO. If this sticks I will definitely be on the lookout for a new job as well as, I'm sure, a lot of the shop.
Hourly or salary? If hourly and they don't pay you for work done while on call, then they are breaking the law based on what I remember hearing from labor lawyers on TikTok
