shut him up and/or revenge. Def was in control, so that argument is out the window. I'm (somehow) fine with the cop not getting criminal charges filed on him, but to keep his badge is disgusting.

of course, but we don't have governmental immunity. it wasn't considered to be for "no reason" I bet. I'm sure his official statement was that it appeared like the suspect was still resisting. Then the insane justification of raising the facts of what the suspect just did (probably flee, etc).

because it needs to rise to a level of outrageous conduct for immunity to not apply and that just seems like a typical illegal battery by a leo in the scope of their duties.

basically, outrageous conduct needs to be re-defined. actually the word outrageous needs to be removed from the factors.

I have first hamd knowledge on this one. Suspect shot up a house and ran. Officer took him down while shit head still had gun in his pants. One hand was cuffed and his free arm was reaching for gun. Officer Rosen did not stomp his head, it was played on our news stations repeatedly. He stomped the shoulder with free hand.

It was reviewed by lesbian chief and ultra liberal city attorneys. They even took Rosens side.

The mayor stepped in and tried to step over what chief and safety director ruled. He had to back down. Since this video shit head has been arrested numerous times and threatens to take others jobs etc.

I call out bad cop actions. This wasn't one of them.

It’s important to note that the poster you’re responding to is a baby size sheriff deputy who only got his job because of his auntie’s connection. He’s one of these officers that walks around scared of every shadow with a blatant hatred of certain people that he’s supposed to protect.

Dude, this thread will confirm, I back the blue line pretty hard core, but this guy stomped on the face of a dude that was under complete control by another officer. Maybe he tried to hit the shoulder and missed. Maybe he was overheated from what just happened with the shooting/chase, whatever, but that dude stomped that guy right in the face.

While that screen cap isn’t a perfectly clear enhanced pic, it does show sole of shoe on face of suspect. To argue otherwise seems counterproductive.

Shockingly, that frame is less clear than the video. It’s like you stopped on the only second where it remotely appeared not to be a kick to the face.

Not exactly. A shoulder kick wouldn't have been disciplined at all they said, but they couldn't determine it was the shoulder. Do you have something where they stated it wasn't the head? From what I gather they just said they couldn't tell.

Internal Affairs said they couldn't tell. The arbitrator in the final report (28 pages), even said it could have been neck, shoulder, or head.

Regardless of whether Anderson's "neck bounced off the pavement because the boot made contact with his face, neck or head, or whether the severe collision was caused entirely by the force of the blow to the upper body shoulder area, the level of force delivered was severe," Goldberg said.

The ruling reduced the discipline against Rosen to the equivalent of a three-day suspension without pay, the original punishment recommended by the department police chief before the city safety director overruled her.

Rosen was also involved in the fatal shooting of a man in 2016 that led to criticism of the police department and a lawsuit.

I'm sure he will produce a statement of someone saying that if they actually did.

A federal judge released courtroom video Monday of the fatal shooting of a defendant who attacked a witness with a pen during a 2014 racketeering trial.

The 24 seconds of video shows Siale Angilau, a member of the Tongan Crips gang, standing up at the defense table, grabbing a pen or pencil, then running to the witness stand and hurdling himself over it.

Along with making the video public, U.S. District Judge John Dowdell dismissed a lawsuit brought by the Angilau family claiming excessive force in the shooting.

"The video completely contradicts plaintiffs’ argument that Angilau stopped posing a danger within less than one second of launching himself over the witness stand while making a stabbing motion with a pen in hand," Dowdell wrote.

Robert Sykes, the Angilau family's attorney, said a jury should see the video and make a decision about whether the marshal used appropriate force. He said the witness got out of the way and wasn’t in danger by the time the shots were fired.

"Those last three shots were all after he's been shot once down on the ground in the back, and that's the problem I have with this case. There was no necessity to use force," he said.

Sykes said he's glad the video was made public, but the Angilau family wants justice. He said it is up to the them to decide if they want to appeal the judge’s ruling dismissing their lawsuit.

    Thoughts?

I'm ok with the first shot, but he could have stopped shooting after the guy busted his ass going over the stand and wasn't in a position to harm anyone. I mean he was laying on his back behind the stand. Of course I'm saying that after watching it on video, not in the heat of the moment. So yea, it could have been handled better in a perfect world but I'm not going to find huge fault in the cop. That was super quick and he did the best he could.

Those shots came in pretty rapid succession. He can't wait for an armed attacker who is 3 feet away from a judge to try and get up before he shoots again

Terrible form, instead of trying to jump over the witness stand he should have tried to dive over the witness stand with the knife pointing out, that was his only chance of getting the job done.
