There was an article a while back on Jared's failures in procuring the material needed to battle this virus that mentioned that Jared and Trump just "wanted to get to herd immunity". Everything they've done supports that theory. Red states will not be shutting down again, they're just going to pretend like this isn't happening and like 300K people are gonna die. I'm like 90% sure Florida will just outright stop putting out any kind of information sometime in the next month and criminal go after anyone who does in state.
Agree that there likely won't be another nat'l shutdown. Dense areas and hot spots will have no choice later in the fall when transmission ramps back up. They will have to pull way back.

Free exercise is a first amendment issue, not a tenth. I’m dubious that an extended prohibition against worship would have survived judicial review absent any other factors, but regardless of my stance on that, I think you’d have to admit that allowing shopping malls to open while ordering churches to remain closed has no viable argument for its constitutionality. The state can abridge people’s free exercise rights through neutral laws of general applicability (remember the peyote and marijuana cases?), but it can’t single-out churches and subject them to a different set of rules than everyone else. So you could enforce occupancy or distance requirements that are applicable to every public space—you can’t say “yeah Nordstrom's go buck wild but fuck you First Church of Christ.”
Bullshit, the limitations are generally applicable laws that have considerations for the spaces being opened. Should churches be exempt from fire code occupancy limits?

Trump “overriding” governors on their use of emergency powers to prevent people from meeting in groups of 10 or more is not a freedom of association or freedom of religion issue in this matter. To be clear, the tenth amendment is what preserves police powers (of promoting the health, safety, welfare, and morals of the people) to the states. By stating he will prevent governors from promoting health and safety, two of their legitimate police powers, Trump is ripping up the notion of federalism and is trying to prevent states (and their cities through charters) from exercising police powers reserved to them. This is well settled law too in relation to the enforcement of quarantines on healthy people. (See Compagnie Francaise v Board of Health (1902)). If you want to claim that there should be a balancing of interests (10th amendment v 1st amendment) I might buy that, but that would need to necessarily be challenged in the proper manners through appeal up to the SCOTUS, not by the POTUS playing loose with constitutional authority, and I firmly believe that any such balancing test will fall in favor of the 10th amendment.

Because you ignored that paragraph in mischaracterizing the state of play with respect to the bans on large gatherings in opining that the state orders are illegal. I have no idea what state’s order you’re looking at, but the Maryland and Virginia ones that have been challenged were general prohibitions on large gatherings of over 10 people that covered non-essential retail (e.g. Nordstrom’s) as well as churches. A district court upheld the Maryland order on Wednesday so lol at your constitutional certainty.
