It’s absurd to suggest that kids that are sick with covid can’t pass the virus to others. That’s just not how viral respiratory illnesses work. That kids may have some innate immunity due to other viral exposures may make it tougher for them to get sick (and therefore pass it on) but it’s folly to assume that people demonstrably ill with a virus and shedding it can’t infect you just because they’re 12.
We opened schools and the numbers kept going down...... But we waited until the virus was very much under control. a few schools have had to send home like the 5th graders or the 8th graders because 1 or more got sick, but no schools have closed again where everyone was sent home. Arguing that in America where the virus is not under control and more and more people are getting it, would lead to the same scenario is fucking nuts. Illinihockey and THF you guys need to get fucked. I’m pretty sure America cant use studies from Germany etc for jack shit since you are not at all in the same position as they were when they opened schools. So yea maybe kids dont drive the infection in the same way but if everyone around them are sick more than a few of them will get sick. Motherfuck people are dumb.
Transmission rates from kids to adults or vice versa isn’t even the entire discussion. What happens logistically when a teacher gets it from, let’s say the grocery store or where ever? 5 day incubation, 11 days for results here in Florida. Do we isolate the kids they were in contact with the entire time? What about other teachers who interacted with them in the lounge? Etc. It’s a logistical nightmare. Not to mention the liability if there is a kid who gets sick. Some kid dies -anywhere- in this and the lawsuit(s) are going to be out of control.
I hate to keep saying this but anyone that thinks covid can't be spread in schools, Israel would like a word with you...
For elementary schools I suspect they’ll close the class, disinfect and make the kids in that class quarantine. The more interesting question is for middle and high schools with rotating classing. They may teach 5-6 classes a day. If a kid tests positive i guess they’ll have to quarantine everyone in any of the classes. This is going to be a shit show.

Fortunately Mitch McConnell is working on exempting businesses (I’m sure schools will be included as well) from lawsuits as it pertains to COVID, so that we can get back to work.

100% chance the debate over the next economic stimulus package focuses on this issue. PPP required employers to keep employees through September. The shit hits the fan, economically, if there is no new program when September rolls around and employers shed payroll.
Which is dumb. It's borderline impossible to prove legally the source of infection so businesses don't likely need legal protection. At least in Florida comp, it's impossible to prove. If it is something that can be proved in a civil case the amount of negligence is going to be so overwhelming that it demands a lawsuit.

I’m handling a COVID death claim in GA right now, so we’ll see how it goes. The widow claims they did not go to church, have friends or family over, go to anyone’s house, didn’t go grocery shopping (their adult children dropped off their groceries). All the guy did was go to work and come home. He got sick and there were a couple others who got sick at his job. It’s not perfect, but I have a shot.
Comp claim? Florida you would have to prove not only was there exposure but the amount of the exposure, show that it was more than the public at large would be exposed to and that the work exposure caused the infection all with a heightened burden of proof. Worst case it'll probably just settle. The publicity on these types of cases isn't great. Our big fights currently are on injured workers that are light duty then furloughed because of Covid closures.

Yea, comp. Georgia hasn't been very clear on whether COVID is going to be treated as an occupational injury claim or an occupational disease claim. I think I can argue either one, but occupational injury is likely the only way I'd have a shot. If it's an occupational disease claim, then I'm looking at a similar standard to what you're dealing with, and an almost certain loss. I told the widow we're really just looking to scare them into putting some decent money on the table to help her out. At the end of the day, we still have a very conservative WC system, so it is what it is.

He had facts demonstrating that the team knew other personnel tested for staph infections and exposed him to staph bacteria as he rehabbed surgery at the team’s facility.
