That's not what they just said. They are not saying it was an unintentional accident, but rather an intentional act based off confusion of the rule.
They never should have chosen a song they thought they'd have to edit. Just pick a different song and avoid the issue completely.

I know this was months ago, but I'll answer what probably happens. Colin Kaepernick will be entitled to a cash settlement that will probably be based on projected earnings over the rest of his career and the CBA will be dissolved. Would be a real mess and the NFL would grind to a halt until a new CBA is hammered out.
This is a good point. They almost took Brady to the SCOTUS over deflated balls so they wouldn't have settled here if they didn't think he had a case. Also must have been a gigantic sum for Kaep to agree and keep it confidential.
The NFL won this won because the Kaep critics can make a reasonable argument this was just about money for him.
Yeah, it's not a cut and dry issue like whether Brady deflated balls or not. You can win this issue in courts and still lose
i think he was highly unlikely to ever play again but this pretty much settles it. wonder if him agreeing to never seek NFL employment again is part of the settlement
They didn't go to those lengths over deflated footballs. They went to those lengths to protect the system they had in place to suspend players after investigations of that sort.
Why would Kaepernick ever want to seek employment again? Not playing the last two years has been the best thing to ever happen to him, and playing again is only downside from here.
He has the chance to publicly beat the NFL and instead takes the cash and a non disclosure agreement. But I realize being objective isn’t welcome on here.
And he doesn't have to risk getting CTE. Usually people that risk/sacrifice their career for a protest end up getting screwed financially because of it. It's nice to see that wasn't the case here. Might encourage more people to stand up for what they believe in.
