My mom owns a commercial real estate management company and they're worried. Thankfully they have most of their buildings under lease.
I guess having current leases is better than the alternative, but a lease doesn't mean shit when the tenant cannot pay. It's gonna be a Chapter 11 bonanza in the fall.
A friend of mine is going through a pretty insane divorce. Looking for some confirmation from folks that practice in this space that my intuition that she's shooting herself in the foot 10+ year marriage. No physical violence. A few weeks ago during a verbal argument W spits on H. H slaps W. 12 hours later (during which time H was in the family home and directly caring for children), after "going to the store" (assume an attorney), W tells H he needs to leave or she'll call the police. W did call police, who interviewed all parties and report is mutual battery. No physical marks on W. W forum shops and gets a chiropractor to say she has a concussion and a "dislocated neck." W requests and receives a PO. H has not seen or spoken to his children in 3+ weeks as of today. W sends multiple written communications and calls various family and friends to tell them H is violent and they should be aware he is a threat to her, her children, to himself, and possibly the friends/family. For example, H stayed with our family for a few days to help him gain some perspective on next steps. Upon hearing he was doing this, W called to discourage us from inviting him and, if we still were, to remove all weapons from our home. H hired an attorney and files for divorce. Sends a preliminary term sheet for how to deal with kids/house/assets/etc during the course of the divorce suit. W, after her attorney suggests she take the offer, fires her attorney. She files pro se for a continuance of the PO hearing, which is contested and denied. She is supposed to be deposed tomorrow in advance of the PO hearing and H's lawyer thinks it is likely she doesn't show for the deposition. Based on folks experience - she's make terrible choices all over the place, right? That's my judgment as a reasonable person with a JD but having no experience in family law.
That's true, but we thankfully live in a city (Huntsville, AL) that's basically funded by the Department of Defense, so there's a bit of a safety net
I mean the way this story is told make it sounds pretty biased again W. Not sure what her side of the story is or what other facts are out there. But if all of that is true then yah that doesn't sound good. Doesn't even take a lawyer to tell you that. Especially if she fired her lawyer simply because he recommended a temporary agreed order. Judges definitely don't like parents withholding custody absent a really good reason , which, according to your version of the facts, she does not have. So that could bite her in the ass. If I was her I'd retain a good lawyer, stop withholding the children from the father, and just go through the litigation process. Also unless he has tons of assets they will both end up spending more money on lawyers than it is worth and would be better served coming to child custody and property settlement agreement. Egos, pride, and emotions are the impediments to an agreement.

I guess part of the deal was that was supposed to be a closed road. But also a lot of those people were involved in criminal conduct. Weird liability case.
That company sued a Mississippi-based auction company I represented in a property/damage loss of use claim. The claim was spurious as to my client because they were trying to impute negligence of a driver on the company. Only problem was we were just the buyer of the trucks being transported, and we were not the driver’s employer (nor were we a constructive employer under federal law). The California/Texas lawyers we dealt with for Kenan were not good and did not seem to understand their argument was bad. Also impossible to get a hold of. We filed an MSJ by the deadline (as did another party) and they did not respond. Right before the bench trial (MSJ was going to be heard immediately before) our client instructed us to offer a nuisance value settlement to avoid him having to fly to Texas for the trial, and they accepted. The other party did not settle and at the MSJ hearing the judge granted the MSJ (disposing of the rest of the case) and awarded sanctions against Kenan in an amount greater than our settlement to Kenan.
Allstate just got sanctioned $620,000 (in addition to having to pay policy limits of $75,000) in Alabama for failing to send an adjuster to a mediation, in violation of the court's order, and failing to tender its $75,000 policy limits which forced a trial where a jury awarded $690,000. The attorney's motion for sanctions only asked for the reasonable rate of attorney's fees for hours on the case - a total of $57,500. The judge's order says: "The Court considers the requested relief inadequate to accomplish the dual purposes of addressing the burden placed on the Plaintiff and addressing the overarching effects of Allstate's conduct on the Courts of Alabama, civil litigants, witnesses, and Alabama citizens who must serve on juries every time Allstate behaves in this fashion" and then sanctioned Allstate $620,000. Can't wait to see the appellate opinion.
