tort reform is not on the top 25 things that the senate is focused on. i feel like tort reform is porn to republicans, so i feel somewhat confident that we have a few more years.
dumbass defense lawyers who want tort reform bills passed are maybe the dumbest motherfuckers on the planet
I think you would need a waiver of conflict from the other potential heirs. Your mother might want to hire a third-party attorney to review it on behalf of her mother out of an abundance of caution.
so funny when insurance companies send you surveillance footage and its the guy taking out the trash. thanks guys you got me
When Facebook was still new, I was at a CLE where counsel put together clips he found online compared to plaintiffs faking injuries. It legitimately was one of the funniest CLE presentations I have seen. He had a guy walking bent over with a cane to his depo, then started showing him photos of him professional wrestling. He had some woman who claimed she couldnt raise her right arm with a video of the woman beating another woman’s ass with someone yelling “Evander Holyfield” in the background.
We were at a mediation one time and defense counsel showed us a video they found of my client twerking at the club and it had the caption “my neck hurts LOL” anyway they paid $80k
we just sent a reduction request on a $25k medical bill. they countered with $500 more than what we wanted. tbh that's pretty smart because we aren't going to argue over $500 and if they do that on every reduction request they receive they are probably pocketing like $200k a year from that strategy
I have a trial set for march that we desperately need to go away but defense keeps insisting on doing depos of corporate reps from the surgical facility and billing company because they’re trying to engineer some sort conspiracy where they can go after this surgical facility directly in all their cases.
i think they settled for not that much but the pain docs business died overnight because state farm refused to consider any of their work and attorneys refused to work with them so it worked
Had a custodian that filed a workers comp claim about an ongoing injury. Found out she was still dancing at a strip club post alleged injury. Still ended up settling for nuisance value.
that is their game plan here, but it seems like the pain docs will just pop up under new practices names and new companies and start the cycle anew
they've done it a lot in Florida. they sued ask gary, they sued 411 pain, they sued integrated whatever in central florida, they sued dr. deuk, they sued whoever else. pretty sure all those dudes are still chiros driving rolls Royce though. Well except Deuk, he was a real doctor.
as far as I know, all of those guys are still operating. They’re exposing their client majorly to go on this wild good chase
it's always fun to ask defendants in their depo if they knew that their insurance company is dragging them through all of this because they have a vendetta against the plaintiff's treating physician and that your client offered to settle within their policy limits but now they could lose everything they've worked for because dale gobel got a hardon for someone doing laser surgery.
Yes, he an (in)famous Rutgers fan. He is apparently a well known attorney but I wouldn't seriously recommend the guy. https://twitter.com/Richard37215662
The two guys I know that handle divorce cases in NJ don’t practice much outside of Bergen, Passaic and maybe Hudson county and def don’t do much with family law outside of that area. Sorry couldn’t be of more help man. Good luck to your friend- divorce generally not a fun process.
I countered and the adjuster responded with "I need to review the actual medical records before responding with a new offer." What is happening.
Allstate offers $1,400 but says they have room to move. We’re not settling for less than the $50k policy ok we will file a lawsuit does it go to a new adjuster or stay with you? you’re not even going to negotiate? I have room to move no?
Had a Liberty Mutual adjuster on the phone the other day. "The ER bill is $20,000, but we know Medicare is only going to have to pay like $6,000 of that" "That's nice, I get to present $20K to a jury, you know? ... "Liberty Mutual doesn't award lost wages for days missed going to appointments." "That's nice, a judge and jury will, tho." ... "Can you accept service on behalf of your insured?"
i really dont know what some of these billboard firms are doing. this one has a bunch of lawyers who litigate files, but... they sent us a progressive case where $20k offer on $33k in medical bills. we filed a lawsuit, got a new adjuster assigned, and settled it 4 days after their insured was served for policy limits. thanks for the $5k for like 20 minutes of work for my assistant i guess.
liberty mutual finally got outside counsel on one of our lyft cases after their inside guy blew off two motion to compels and got sanctioned. kind of upset i was looking forward to trying this one against that dipshit
a geico in house lawyer took a 7 hour depo of our client the other day in a case where the injuries are road rash and a broken rib. fortunately i do not attend these any more. our youngest lawyer then took the defendants depo and she made the longest, most absurd speaking objections the entire time and it took 6 hours. i dropped in his office and interrupted her to ask what on earth she was doing. she then started emailing the court reporter after the deposition asking her to go print the screen of the e-filing page for the case and attach it as an exhibit because she claims I am not an attorney in the case and it was improper for me to interrupt the deposition. bart simpson writing on the chalkboard "i will not get into an email battle with an in-house lawyer on a 25k case"
going to really piss off the insurance company when he sets them up for an excess verdict by blowing a stowers and then opens his firm up to a bad faith malpractice claim by constantly saying he reps the insurance company
In states that allow you to claim the retail medical bill and do not allow evidence of collateral source health insurance payments: How do you practically put the bill in while keeping evidence of payments/adjustments out? For example, I have a $10,000 hospital bill that shows a $1,500 BCBS payment, an $8,300 adjustment, and $200 outstanding. Do I just redact everything below the $10,000 total and put the redacted bill in?
