We do 3 for 3 . If the staff gets 3 google reviews from clients for the firm in any given week , the staff gets to leave at 3pm on Friday and whatever hours were left in the day are paid time off. This place is usually a ghost town 3PM Friday. That has been very popular. Also give them $50 amazon card for every review they get from a client. I guess insurance companies and law firms have real concerns when they fuck up and say the insurance company is their client and not the insured. has happened twice with me in the last few months and both settled within 48 hours of me sending them a letter about how bad they fucked up So if that ever happens to yall make sure you save it to your file

Can I just fire her and immediately remove her from our firm's health insurance? Are there any downsides to keeping her on our health insurance through the end of March, other than having to pay for it?
you remove them immediately but the health insurance will typically stay in effect until something like the 15th of the next month. You can offer them COBRA. There are COBRA forms you'll have to fill out and send to the health plan . I'd just get on the phone with the health insurance company about it.

I thought all you plaintiffs guys were in this profession to protect the public. It’s not supposed to be about the money. I’m going through a summary judgment opposition where plaintiff filed 62 exhibits, likely hoping the sheer volume will cause our judge to throw up his hands and say issue of fact.
As of right now yea. I’ve kicked around adding states but I ended up doing 300 mediations last year, which feels like plenty.

We do not have nearly enough mediators in my city. With little exception, those that we do have do not, or did not, practice the type of law that I practice. I'm almost always having to hire someone from a larger city to mediate my cases. I probably need to practice for another ten years or so before I would get any real traction but its definitely something I plan to explore when the time comes.
OC has blown off getting us responses to initial disclosures that were due on 10/15; his client's discovery responses were due in December. I email him multiple times and he claims health issues so I give him some more time. email him again with no response. i call the carrier and let them know dude has missed multiple deadlines and just let them know that they're a little fucked if he doesn't start working on it. email him yesterday: If we do not get these by tomorrow at 5PM we will be filing a compel and we will not pass the hearing. If you are unable to work on these cases because of health issues, you need to give them to someone with the ability to work on them. his response Yeah, man, maybe I should also hire additional staff, and stop taking new cases from most of my carriers. Defense lawyer has taken the stance in his brief that we needed to specifically request that his client, a multi-billion dollar company, have their employees save their company issued cell phones. Amongst the many problems with this argument their own litigation hold letter says save them whoops
im 5 months late answering discovery because my employer won’t give me proper staff and also won’t let me reduce my case load or give my current staff overtime but I don’t usually put that in emails
he has talked to another lawyer who told him that his case is worth $100k and is pissed we didn't get him compensation for the daily knee pain he has. wreck was in october 2022 and 0 mention of knee pain anywhere. really hoping the bar just dismisses the grievance without me ever knowing it was even filed.

the girl lawyer i know who posts on instagram every day about how she is a law boss just posted on the texas plaintiffs lawyer listserv asking for sample depo questions for a disputed liability defendants depo I have a small car wreck case. Liability isn't that great. My client was making a left turn, across three lanes, into the shopping center. It was around evening rush hour with stop and go traffic. Cars were slowing down due to traffic light ahead. The lane closest to her and the middle lane yielded to her, the last lane didn't yield or slow down, neither did my client when make the left turn, and they crashed. I feel at a minimum this is 50/50 liability but since the carrier didn't agree I sued. I'm doing defendants depo tomorrow and not sure what sorts of questions to ask to "nail" liability. Any sample questions would be greatly appreciated!
random thought. this probably excludes a lot of you in the south, but I find snow / ice slip and fall cases to be some of the oddest to litigate. filed based on premises liability and a reasonableness standard. I am often representing the property owner or the contracted snow removal entity. and more often than not, they were at the site the day of the accident. I am told time and time again that you can treat it and clear it best you can, but if it is under freezing temperatures, you can only do so much. And then there is the issue of melt and then re-freeze after the snow removal company leaves. So much of it is unavoidable (especially during an active storm) unless the snow removal company never leaves the site and just keeps working endlessly. Getting comparative fault for someone walking over snow and ice almost never happens. I find these facts and cases to just be really odd and extremely plaintiff-friendly. on the other hand, some of the most unskilled and unqualified small business owners run snow removal companies. simply buy some equipment, shovels, and supplies, hire some laborers, and you can easily secure contracts for snow removal. knowing what you are doing is rarely a prerequisite. I have like 5 slip and fall cases right now
i wonder how much money progressive loses every year by having all their small policies ending in $55. i just deposited a $30,055.00 and a $50,055.00 and was just thinking that's $110 that just didn't need to be there.
I defended a slip and fall on ice outside a dialysis clinic that resulted in a below the knee amputation. It was a pretty wild case. Fortunately, my client was at the absolute top of the indemnification chain.

Admittedly don’t remember, but less than I would’ve taken now. Plaintiff had some problems. Her noncompliance with care and hygiene were a big part of causing the amputation. But, it was still a bad situation.
