correct. From what I remember, he moved into the shoulder on the right hand side to pass a car in front of him and immediately ran into the Gaudreau brothers. Not going to get far with a contributory negligence argument when that was your move right before the crash.

This is exactly what he needs to prove. In my very limited experience with this area of law, the mere fact that they were drunk is not as relevant if he can't also prove they were operating the bike erratically. So yes, that needs to be his hail mary. But even then, the fact that he pulled into the shoulder on the right to pass the car in front of him is going to negate any real negligence from the Gaudreau's.

It was worse iirc. He passed to the left illegally a first car then swung around to the right to pass a second car. The second car was shifted slightly to safely pass the brothers so at this point when he went around that second car is when the impact happened.
well that's based on witness statements and forensics, right? we don't have video? so the plan is to inject some doubt into how far over he was I assume
Assuming he was driving a car made after like 2015 the computer in the car will say exactly what he did in the moments before the crash. his accelleration rate, speed, steering wheel turns, etc. All recorded. That combined with the witness statements will make it very difficult to claim there was much contributory negligence from the Gaudreaus
I may have this wrong but I thought the brothers were riding their bikes on the side of the road. So not sure how their BAC would even matter if you struck someone not even on the road. Like you can’t say a pedestrian on a sidewalk was drunk as an excuse as to running them over on the sidewalk.
I'm sure the lawyer will try and make a claim that they weren't as far over on the road as the police report said or whatever
depending on the state, operating a bike on a road while intoxicated can get you charged with a DUI. But like you said, assuming that even though they were drunk, they were on the side of the road and operating their bikes in a safe manner, driver's contributory negligence argument is going to fall on its face.

(I am not a crash reconstructionist, but I supervise people that are, so I can add a little to this.) This is true, but only if an “event” was triggered and the cars Data Recorder logged it. Pedestrians often get hit and killed by cars, but it isn’t a violent enough collision, or braking reaction, to trigger the EDR. A bike obviously has more hard points than a human, so hopefully they were able to download the vehicle, but it isn’t a guarantee. If it does, then yea you’ll get speed, steering angle, brake/gas pedal depression, g forces, everything. It’ll paint a full picture. Regardless, this is a Hail Mary, as has been stated.

Even if he is able to prove some culpability for the cause of accident by the brothers, it doesn’t throw out his charges. Like others said, it’s a Hail Mary, and really meant to try to limit his sentence vs get out of it entirely

I think it’s still Bedard because I am a pussy but Celebrini is trending towards being a 90 point two way center. Bedard seems like he’s trending to the wing and that changes things.
Chicago was always going to be a large rebuild but I’m amazed at how little Davidson has done to put real talent around Bedard. This is why it’s not so simple to say you tear it down to the studs, get a top pick and just coast to respectability. There’s definitely a balance to be had. I think Davidson has assembled a nice prospect pool but he’s wasting Bedard’s development at the same time.

Yeah, it's really close for me for the same reasons. I still think Bedard in his prime with good talent around him is a 50 goal 100 point player even if he never develops as a great C, but Celebrini looks like a special two way player with serious offensive upside as well.
