Why didn't she pick a jury trial? Stupid.
That judge is likely to give her some prison time and likely put her on probation for a significant amount of time. It is highly, highly doubtful that the Mass SJC overturns this verdict under the guise of Free Speech.
That is the thing that gets me. You just needed to convince one person, who wasn't a legal scholar, that she was not guilty for one reason or another. Possibly by the crackpot theory the expert had put forth in her defense about her medication. But instead you roll with a bench trial with a notoriously hard judge. Thankfully she can't use Ineffective Assistance of Counsel as an appeal point.
I bet the thought process was that a jury would be more inclined to punish the conduct whether or not it was actually criminal.
Here's the standard for involuntary manslaughter in Massachusetts.
This is a notorious hard ass judge (who I know personally), there was no way they were concluding this wasn't Involuntary Manslaughter to someone who knows the law. That said, you just needed to convince 1 juror that it wasn't and you at least get a hung jury. The expert testimony they offered was pretty much BS, but there is a good chance a juror felt for it. Typically speaking, and this comes from the Juvenile Court judges I know, Massachusetts juries are easier in Juvenile Court.
I know how juries work. I probably would've asked for one. But, I can see the logic in going the bench trial route in a case where the conduct is this bad and the likelihood of bias is so high.

Not nearly harsh enough. Probation should have been much, much longer.

With a stay of incarceration pending appellate courts rulings/ Federal Court 1A rulings. She won't be seeing the inside of a prison for a while.
They should just text her "you want to go to prison" until she does it

Seems to be a difficult case altogether. She didn’t kill him, she just planted so much bullshit in his mind that he killed himself. What she did was obviously horrible but the crime itself is pretty abstract. I’m happy they were able to get a conviction at all.
By the way 12-17 year old girls are the most devious creatures on this planet.
