    My wife has a couple physician friends originally from different countries & they say the meds we give out here for garden variety b.s. are what they give out to later stage cancer patients in their home countries.
    They've also had patients complain bc they didnt think they were getting strong enough drugs and that they think the level of patient care abroad must be lower bc they dont push heavy narcotics for everything.

    I applaud the action but I always kind of think fines won't be effective. Purdue made 30 billion in revenue since the crisis started. They paid a 650 million dollar fine (a record amount). But I am guessing most businesses would be willing to pay a 2% fine to collect 30 billion. We need some of these assholes in handcuffs if we want to send a message

    Even more, when these judgments hit, the defendants are just going to try turn it over to their insurers and pay little.

    Remind me, what’s Johnson & Johnson’s role in this other than having the deepest pockets of those named in the suite?

    Think I remember reading they owned some material manufacturing facility or mine or something that produced a substrate that manufacturers used in making narcotics.

    Every state is different. This one goes to Oklahoma’s general fund, per a law the Oklahoma legislature passed this year.

    They don’t have to use it for anything opioid related.

    Tax cuts is my guess.

    If the company was in compliance with U.S. federal and state laws regarding their products, that wouldn’t seem “unchecked.”

    It's gross that they got hit with an almost $600 million fine and their stock went up 4% because it wasn't as bad as they were expecting

    The drug makers and wholesellers are required to report all of their sales information to the federal DEA.

    The industry is at fault, but the DEA had all the data showing millions of pills going to these rural, low population counties.

    The DEA did nothing with it, even though we’re spending ridiculous amounts of money on drug interdiction at the borders.

    The DEA doesn't have the resources to take on big pharm. Intersect 500 kilos of blow, a huge fentanyl shipment from Mexico, take pictures and whack each other off but it does nothing and just empowers these fucks even more.

    We let the banking industry ruin our economy then bailed them out just for them to use that money on vacations and bonuses so not sure what we're expecting.

    The AMA or whatever the official acronym of the top healthcare professionals in this country nees a huge overhaul of their practices as well.

    Get them hooked but when they admit they're hooked and need help, they literally do nothing for them.

    This isn’t true. It’s really difficult to prevent doctor shopping. There are state/federal privacy laws that can limit access to data that prescribing doctors need

    They supposedly bought a farm that supplied over 60% of the opioid material and also had their own products. They helped develop the campaign that targeted docs to overprescribe by saying that patients had pseudo addictions and weren’t really addicted. They just needed more drugs to make it go away.

    Oklahoma is the plaintiff so the money goes to their govt. and supposedly programs to fight the crisis. That said, they brought in over 1 billion so far between all defendants. The question is can we trust them to use it in this way or are they just reimbursing programs that they already have. In any case, I don’t think it goes primarily to legal teams, as stated above. This wasn't a class action lawsuit.

    Yea this changed a few years ago. I remember reading a study on how effective this marketing is. Apparently if a patient requests a specific medication the doctor is like 3 times as likely to prescribe the specific one they ask for. (Estimating due to memory loss)

    In college I interned at Eli Lilly (Cialis, Prozac, etc). At their HQ in Indianapolis they have a display behind glass honoring the man who created the term "Ask your doctor about..."

    The thing is it has gotten better. You used to be able to advertise for stuff your drug wasn't even approved for. Think gabapentin was the major drug (neurotin) for the govt involved. They were pushing it for hiccups.

    Cases have split on the duty to defend.

    The MDL docket is different because those cases are almost all RICO claims promising federal jurisdiction under the statute, then consolidated under MDL rules.

    There are state cases as well. Several coverage cases arose from the State of West Virginia’s case.

    I’m familiar with the duty to defend cases. Has there been any decision about a duty to indemnify? It’ll come down to the specific policy and the claims asserted, but I would expect the general rule to be no indemnity.

    Not sure about that, but my guess is that defense does not erode limits and they settle because defense costs are going to exceed limits.
