So... let's read between the lines here. What happened in 1913? Well, that's the year the 16th Amendment was ratified - the income tax, and the Federal Reserve Act passed Congress and was signed into law by Woodrow Wilson. So, I promise you what he's going to do here is cut the fuck out of (or straight up eliminate) income taxes for the gentry class and pay for it by tariffs and a national sales tax (both highly regressive, of course). Who knows what they have in store for the Federal Reserve, but probably nothing good.
as of today, most federal employees (particularly ones who survived the culling of probationary/new employees) have statutory civil service protections that provide due process when the government suspends them for more than 14 days or fires them. Failing to respond to this email, or providing answers doge spits out as inadequate, is by itself an inadequate basis to fire a federal employee. Beyond that, Elon announcing that those who don’t respond will be fired further kneecaps any attempted firing. If they do fire a fed, the fed can appeal that termination to the Merit Systems Protection Board. The case will go to an Administrative Judge, who will overturn the termination. But there are only so many judges and there are going to be a ton of cases in the system. After that, whoever loses before the Administrative Judge can appeal to the MSPB board members. There are three of them, and two constitute a quorum. Trump fired one (being challenged in court) and a second one’s term expires on March 1. There’s already a backlog of cases from the last time there wasn’t a quorum, and once there isn’t a quorum, the appealed cases will just sit on the MSPB docket indefinitely (ie years). And the MSPB will like have two Trump appointees on it by the time it hears any cases. After that’s done, the MSPB decision can be appealed to the federal courts. Add a few more months/years to the process. what I’m not sure about is if the employee wins before the administrative judge, whether a government appeal holds off any reinstatement of the employee. They would get back pay when reinstated, but few employees and employment lawyers are going to be in a position to wait it out.
I know it will never happen, but since legality is no longer relevant it would be fucking great if every single government employee, especially anyone in the Secret Service (lol as if they're not fascists) just stopped showing up for work altogether come Monday. Not a "strike," per se, just, you know, a walk out.
