Kushner needs Congress to pass an immigration bill that provides more explicit statutory authority for DACA (which is an executive action not requiring explicit statutory authority) but he’s pretending it’s something only Democrats want when in reality the White House doesn’t want to own ending DACA because it’s a broadly popular program.

If he makes a deal, he raises his risk of losing the election by pissing off his base for both making a deal and the likely concessions he’d have to make to Democrats at this point to get one done. And if he doesn’t get a deal done and his decision to challenge the law with the help of the scotus he shaped “worked”, he raises his risk of losing the election by pissing off a substantial portion of the voting bloc in key swing states. Couldn’t have happened to a more deserving person.
