Irt to “how didn’t he know during/after the first encounter?” - I’m almost certain I saw episodes of Catfish or Dateline where a lesbian catfishes her straight friend she had a crush on, creates a whole kink/fetish ruse where the straight girl is blindfolded waiting for her catfish in a hotel or something and the catfish lesbian proceeds to fuck her with a strap-on… iirc they had a few encounters like this before the girl took off the blindfold and saw it was her gay friend/a woman, not a man. So I can conceive a situation, convoluted as it may seem to us, where some dumb horny 18-19yo finds themselves in a weird situation getting a hummer from a dude. And if that’s the case/scenario, is it not sexual assault/rape at that point?

What I read today said that previously in court that he was grabbing around trying to figure out if it was a guy or not this second time. So something weird happened and it doesn’t seem to be like he in the moment was surprised. (Which in VA is now not a legal defense) Regardless he still shouldn’t have murdered the guy. One punch and run, sure. Bash his head in? Nah.
this comes off as extremely homophobic it doesn’t sound like the guy was in danger. It sounds like the guy thought enjoying getting a blowjob from a guy made him gay and reacted to that. It’s bullshit and murder.

Saw that too, but there’s some questions as to whether they were arrested or not? If not, it kind of blows up the idea they went there with intent to beat the guy up or w/e. From the article it says he started groping around and used his cell phone flashlight to get a better look at the person in the darkened apartment. Which supports my hunch this guy manipulated scenarios where he could sexually assault people under false pretenses and deny his victims the easiest opportunity to reject him. I’m also curious if clear cut cases of murder go to grand juries?

vigilantism Is never justifiable. Him doing it in the heat of the moment i might understand but that doesn’t seem like what happened here. If it’s simply him being angry and embarrassed than what he did was murder.

I mean, it's a young black man in Southwest Virginia being accused of murder, the prosecution must have been fucking terrible because there's still plenty of people in this area who would have to take off their hood and robes to sit on the jury. I'm just dismayed he was found not guilty, not that he somehow "got away with it", it seemed like such a slam dunk.
Pry wasn't coach when this unfolded so nobody knows and I'm not even sure the kid would want to stay in the area. I doubt it happens but who knows. the word about him prior to the incident was he looked very talented and promising, I'm sure he can land somewhere.
Ah ok, i know nothing about the case and the area. But by reading the tweets it made me think of a guy beating another one to death once he saw that the girl was actually a guy and then claiming self defense because a knife was hidden under the bed. i am obviously completely off track here.

That’s interesting. The initial reports were he thought Smith was a woman and was shocked upon arriving to find out he was a man. It came out in the trial they went there to figure out if he was a man or woman. In my opinion, there’s no defense. You can’t argue the shock filled him with rage and he just went too far. Awful situation. Stunning verdict.
I think once he knocked him down that's fine? Not really fine, but not sure how else to explain it. The multiple blows with his fists and at least 2 stomps to the head was way past the point of self defense imo
That’s not what the defense was. He testified that the catfisher was reaching for something after he smacked his hand away. That was corroborated by one of the other guys and a knife was found under the mattress. All of that coupled with the victim being a sexual predator makes this verdict not terribly shocking.
I understand that’s what the defense was. It also wasn’t claimed for several days. The evidence now suggests he went there for a confrontation.
Those people who would have to take off their robes and hoods to serve on a jury are very likely to be huge homophobes on top of being racist. I guess in this situation their homophobia was enough to overcome their racism.

The charge being murder and not manslaughter was what helped him. Though the jury could have reduced it to that. Based on the testimony I think there is doubt it was murder. I think manslaughter is more likely what happened.
Successfully using “gay/trans panic” defense in 2023 seems really fucked up and shouldn’t be allowed.
