so is this the timeline? 8/12 - the domestic dispute with the police reports 8/17 - guy flew home to Florida 8/23 - guy flew back to van (Salt Lake City?) 8/25 - Grand Tetons; girl supposedly sent a Snapchat message saying they were heading to Yellowstone 8/30 - Text from girl's phone saying no service in Yellowstone (As an aside, that couple were killed shot some time between 8/13-8/18 as that's when they were last seen and then their bodies were discovered.) It also seems like 8/12 was the last "new" Instagram post from her. Is it known who last saw/spoke to her? Is it 8/25 in the hotel in SLC? Is it known when the guy started his drive home or at least when he arrived? I don't see any way that this guy didn't kill her. But maybe I'm missing something in the time line.

I can't speak to other states, but I think a good argument could be made for bolded part to charge 2nd degree murder in Michigan in that scenario (from jury instructions). You'd also have to argue he caused the death, but I think that is pretty decent argument to make as well. I'd guess there is similar language in other states First, that the defendant caused the death of [name deceased], that is, that [name deceased] died as a result of [state alleged act causing death]. Second, that the defendant had one of these three states of mind: [he / she] intended to kill, or [he / she] intended to do great bodily harm to [name deceased], or [he / she] knowingly created a very high risk of death or great bodily harm knowing that death or such harm would be the likely result of [his / her] actions.
