glad this guy looked into the case law (or already knew it) and wrote this article. I figured this was the analysis for the "citizen's arrest" defense, but glad he confirmed it. Interwebs people thinking their attempt of a citizen's arrest bailing them out for killing Ahmaud are way fucking off. Greg McMichael told police that he and his son believed Arbery was responsible for burglaries in their neighborhood, but Georgia does not make it easy for citizens to go around arresting each other. Citizens are entitled to use reasonable force to arrest people who have committed crimes in their presence or immediate knowledge (courts have held that these are synonymous). The most important part of this statute is the unwritten bit — you are allowed to make arrests only with “reasonable force.” You can’t burn down an orphanage to catch one child snatching extra bowls of gruel. And the Georgia Supreme Court has held, as a matter of law, that you can’t chase someone down with a weapon because you think they have committed burglary. For example, it held that there was no evidence of a “citizen’s arrest” when a man with a baseball bat chased down someone who burglarized his home. The McMichaels will have a hard time establishing that a crime was committed within their presence or immediate knowledge. But even if they get past those serious hurtles, they’re still stuck justifying hemming an unarmed man in with a truck and guns when those acts are each serious felonies under Georgia law.
Pretty sure the 3rd one they are referring to was the first shot when he was holding the barrel of the gun. It was said earlier he was shot in the hand.
I thought the son shot 2x but could be wrong. I know the dad had his pistol out so I figured it might have been from him
From everything I have seen and read. The Dad never fired any shots. Just 3 shotgun blast from the idiot son
“Third bullet grazing his right hand” is confusing since shotguns don’t fire bullets. Makes it sound like the dad fired of a shot that hit Ahmaud.
My perception of the events the first time I watched the video - it looks like the son is out standing on the driver's side of the truck as Ahmaud is running up, Ahmaud goes to the right side and the driver goes and meets him around the hood of the truck, pointing the shotgun at him. Ahmaud grabs/pushes the shotgun away from him thinking the guy is only trying to intimidate, son fires a shot which grazes his wrist and immediately turns it into a fight for his life when he realizes this motherfucker actually is going to shoot him.
Yea that's what I saw too. If you slow the film down, you can see the son standing in front of the truck bc Arbery had gone around the right side. He went to Arbery, not the other way around.
I couldn't stomach watching it enough times to deconstruct it that much. I watched it 2-3 times and that was enough.
Same, I saw the screenshot someone posted on Twitter. As the camera jumps around when they are off screen, one frame shows the son in the front of the truck.
It's the South. The wrist bullet is probably from a separate attempted lynching from earlier that day.
First this guy takes Mark Wohlers' career, now he takes Ahmaud Arbery's life. But seriously, this is Georgia, they're going to find a way to acquit these guys. It'll be this generation's Rodney King case.
that jury selection will be very interesting assuming nobody shanks these 2 dickwads before this goes to trial
I thought about that too but I don’t think any of the forensic firearms analyst refer to slugs as bullets. It’s all semantics anyways, just thought it was odd phrasing.
I know he's not light skinned, dude. I was fucking with you about posting a picture that's not in color to support that point.
Peak caucasity at the end of the video. Stewart apparently called the driver's employer and demanded he take the clip down.
Also, what are the odds that both of those dudes would be wearing the exact same thing? Is dad hat + henley + crewneck undershirt+ blue jeans + running shoes the official uniform for suburban whites in Oklahoma?
“All we want to know if why you’re in here and who have you the gate code.” Should have answered “your wife”.
Fuck that piece of shit. He better get fired from the HOA and ideally his job. Hopefully his wife divorces him. Man driving a massive fucking truck, what the fuck do you think he was doing in your neighborhood. HOAs will never not be terrible and worthless
probably one of if not the most fucked up part of this is that the driver might have felt uncomfortable calling the police because he didn’t know how they’d treat him. Yes, I am aware he called after they got out the way.
I know of that dude...he was one of the owners of Zeke's Marina in Orange Beach; it went into bankruptcy, as did he and his wife...No one is firing him, he is self-employed
