I don't practice criminal law but I think the prosecutors will have a difficult time securing a conviction on that charge given the definition. Proving conscious indifference to human life, the civil equivalent, is one of the highest burdens I face in my line of work. It is incredibly difficult to prove and I am sure the state's case law on that topic supports my position. He'll end up pleading to a lesser charge.
