There are few things that motivate me harder to fuck up a defendant than getting jerked around. They beg me for mediation, have me put off highly significant depos until after we “try to resolve it early” because they know liability is really, real bad for them, then show up at mediation telling me the case is nearly worthless. I’ll be taking my parking lot fights to supermarkets other than Publix from here on out!
Obviously a lot depends on the different facts of the case (ex. first time offender, what was the offense, prosecutor, judge, etc...) but a defendant is able to request a certain location. It does not guarantee anything but it can be taken into consideration. A person very close to me was convicted of a white collar crime and sentenced to a federal prison for 1 year + 1 day. Based on all the facts of her admitting to the crime, helping the harmed corporation find other embezzling schemes, working with the detective, etc... she was able to request a certain federal prison closer to a support system. Though she qualified for the Minimum/Camp level facility, she fucked up in her research and requested "Tallahassee, FL" which does not have a Camp level facility. The Camp level facility is in Pensacola, FL. Tallahassee has its own federal prison that, at the time, housed incarcerated individuals from the low to medium to high range.
I am getting jerked around by my own expert. He’s refusing to timely provide dates for his deposition. Now I’m in violation of a court order from a famously cantankerous and strict judge about how fast I need to disclose things and will likely need to continue the trial. I fully expect the judge to reject the continuance and make my life even more difficult
I have a client who has been catfished and is trying to borrow $10k from a litigation loan company to send to his fiancée who has been deployed to an undisclosed location for the U.S. military and can’t access her domestic bank accounts to get a flight home.
I need a continuance in a case where my clients started getting additional treatment after we filed a notice for trial. explain to clients that this is going to be highly beneficial to them in the long run. Trial was set by judge without a conference for a date neither side would have picked other side is unopposed and we agree to move the mediation this Wednesday after we file the motion today. Sent over the consent form to the client. they call me today and say they don’t want a continuance and are ready for the case to be over. opposing counsel has been really cool about everything and now I get to call her and tell her that all the work we did was actually pointless and surprise the mediation is back on.
I think I'd double down with the client and basically go to the mat over it and demand it get continued
im so upset. Theres a good chance our expert gets struck also since he dragged his feet in getting me depo dates for the opposing side so we need the continuance for that reason also. this particular judge is also a dick who regularly denies good continuances for no reason. He also set the trial date without consulting me or the OC
I think they might like just a check for the $600 it ended up costing per person and no event at all.
Ever heard of Jocelyn's ? She was a renown creole chef round these parts. Now her son Patrick has all her recipes and operates a creole restaurant in the same location off Highway 90. Its signature dish is stuffed soft shell crab. I had triple tail with lump crab meat. Part of it is my fault I ordered an ass ton of appetizers that covered the entire long ass table. Marinated crab claws, shrimp remoulade, etc. And we spent a shit ton on drinks at dinner. There's a $400 fee for renting the whole place out. We did The Wilbur which is a speak easy in downtown OS for cocktails, then Patricks for dinner, then one of my partners opened up a tab at a downtown restaurant for them after dinner but I peaced out after dinner.
in some multiparty litigation right now. instead of emailing me asking for copies of answers of the other parties, a paralegal sent a letter to the court and tried to pay for them. like.... what is you doing bb
really cannot emphasize enough that if you have some decent uber/lyft cases to do some digging. we have one with bad injuries. apparently uber/lyft will only allow their drivers to have 3 moving violations over 3 years before they deactivate their account. our dude had 3 speeding tickets since 2021, then caused a wreck where my client has a lymphedema in her leg that is not curable. on at least half of these rideshare cases we find shit like this.
I currently have a logging truck case. Driver fell asleep at the wheel. Do some digging. Not only is he a convicted sex offender, didn't have a valid CDL at the time of the accident.
I'm probably going to have to try this one. 5 Plaintiffs--nobody too bad hurt but in incredibly liberal venue. They keep wanting to negotiate. Only have a million. Carrier is going to have to learn I guess.
The question of the day is whether our appellate courts will consider the following a dangerous condition that a premises owner is liable for in the event of injury due to same: a large, exposed , jagged, and uncovered water line pipe in a grassy area of a commercial property by the road that people only sometimes walk through which they didn't know was there. Even if they should have known it was there they can argue no one should have been walking there. Or it's an expected type hazard in a grassy field where a bunch of utility lines run. We have bad premises law.
Anybody have experience on vehicle titling in the southeastern US? Without going into too many details, my friend (who is a truck dealer) bought a truck in cash and received clear title from the DMV. He then sold the truck, but someone is now contesting the original sale, saying that the original "seller" was not authorized to sell the truck. Friend has the Bill of Sale and the clear title issued, but is worried there may be recourse.
Isn’t the real issue here whether the individual walking through the lot is an invitee or trespasser? No duty is owed to the trespasser. Also, an invitee can exceed the scope of the invitation if they enter non-public areas of the premises.
That is one of the big issues. Was trying to keep it simple here. She was either an invitee or a licensee.
It's a hospital complex and there is a grassy square type area by the road. There was a display the hospital had put out by the road in the grassy area. That's where it happened. I think it's likely to get tossed on MSJ as our appellate courts will say it's not an area meant for traversing and even if assuming she's an invitee they don't have a duty to guard against every little pipe and obstruction in an area not meant for traversing by the public. We have a pretty narrow definition of what constitutes a "dangerous condition."
Trespassing, I bet, exceeding the scope of her invitee status by entering parts of the premises not open to the public.
If the hospital owning the land is a tax exempt classified as a public charity, could you not argue that public charity status effectively means the surrounding land is pseudo public land?
Surely those can be defeated by making policy arguments to the trial judge in a Mississippi state court
She worked for a hospice company. She would drop by the nursing home at the hospital complex from time to time to see if they needed help with programming . They had an upcoming Christmas program and they did want help such as extra food , materials, etc. Defense lawyer is quick to point out that she wasn't doing this out of the goodness of her heart ; she was there for marketing and sales. The nursing home was benefitting from her though as well. So I'd argue she was an invitee. At the very least a licensee. Anyways after she gets done meeting with her point of contact at the nursing home, they walk out to the parking lot where plaintiff gets in her car. The other lady walks through a grass area out to a display out by the road that is sitting funny and needs to be straightened out . She is struggling with the display . Plaintiff as she drives down the driveway out to the main road sees her struggling with the display. Pulls car over in the driveway , gets out, starts to walk out towards the lady struggling with the display through the grassy area, and steps basically into the exposed jagged pipe which pierces into her leg moving muscle into a different compartment permanently disfiguring the leg and causing other damage. If I had a plaintiff friendly judge I think I could get to a jury. But I have the opposite of that. So I see this getting tossed on MSJ.
Completely and totally underwater with EOY work, and it just keeps coming. Clients popping up out of no where with all sorts of requests. With zero warning/heads up, I just received a complex LLC agreement for a $250m+ private credit fund and I've been asked to turn comments by 6pm tomorrow--on top of a dozen other client tasks. Oh and my wedding anniversary, Christmas, and birthday will all take place between now and the end of the year.
Talked to this client and they were cool and understanding (“I don’t celebrate Christmas and want nothing more than to slip away from my in laws for 4 hours to read an operating agreement”). They have offices in NYC, Aspen, and LA. I may be a masochist because I may try to complete the scope of work anyway in hopes of an in house offer. Fml I’m falling into an obvious trap of hope

Jury trial in one month in the case where Defendant truck driver is in jail . I have a transport order entered by the judge in my case for the prisoner. I feel like this is going to backfire on me and the jury is going to feel bad for this guy. That would be my luck. He did get over in a tractor trailer on top of my client . I asked him if he followed the safety rules for changing lanes in a tractor trailer in his depo in prison. He basically made it sound like other people just need to get out of his way and he just gets over and hopes for the best
