Wowwww.. Someone mentioned this in person and I went to tmb before google. Very interesting, can't wait to read the motion, hopefully it is online. Props to the Baltimore SAO! Glancing at the article, it looks like the police had another suspect, and told the prosecutor, but the prosecutor never told the defense. Seems to be a rather clear Brady Violation. Although I did work on an appeal where the court ruled that the brady violation (alternative suspect theory) was immaterial because the evidence would not have changed the outcome of the case (the other suspect was arrested a county over the same time the murder was happening). It is possible (I have not read the motion) that the police ruled out the other suspect and then verbally told the state that it was a dead end. Hopefully the police have records of their investigation and/or that prosecutor is still around. There are still some major problems for the Jay lied argument.. Jay brought the police to the car. I believe the police focused on Jay because of his girl. His girl told the police that Hae was strangled, etc etc... Safe to say Jay knew all about the crime. If Jay is a murderer, or a co-conspirator with some other murderers, does he even mention it to his gf? His words to that girl set the whole thing in motion. Seems more believable that he spoke to the girl because he felt so bad about what he knew Adnan did. Or maybe the police royally fucked Adnan over, most of what we know is a lie, and Jay is also innocent. It has happened before. *Believe her name was Jen.
The undisclosed take was that the police created a narrative and then steered Jay through it. This was an explanation for why Jay’s story changed so dramatically as the evidence changed.
I remember thinking that the only evidence that Adnan killed her was that Jay knew where she was and took a deal from police to tell the story. And somehow Jay was ok and Adnan was convicted. Seemed like Jay should have been the suspect.
My first takeaway from serial, which stuck with me, was that it was nearly physically impossible for it to have happened the way the state says it did unless there was elite level efficiency and luck.
the only thing I remember is how chill Adnan was about the whole thing when being interviewed. Maybe I am remembering it wrong but he seemed very accepting of his fate
Local news reported yesterday that the property where the car was found belonged to a relative of a suspect, I am guessing the suspect is Jay but the news didn't say. If this is true, this should be a slam dunk for Adnan
I remember thinking at the time that he was the most likely killer but that the state hadn't proven it beyond a reasonable doubt
Same. My thought was it seemed unlikely that adnan would be so cool and meticulous with killing then just half ass bury a body barely off the road. Jay on the other hand? That seems like exactly is music.
Jay was the one who strangled his girlfriend and was arrested for it and threaten to kill her. From what I've seen the family member whose home backed up where the car was found was a relative or connection to Alonzo Sellers aka Mr. S who stumbled upon the car.
Allegedly he did it at Best Buy and called jay to come help from a pay phone that may or may not have even existed at Best Buy and they eventually ditched the car in a neighborhood
Just starting this. Sounds like there is a suspect that threatened to kill Hae. Not sure if this is also Sellers, who found the body and had the car found on/near his relative’s property. They say they’ve been asked not to speculate.
How I recall the gist of it: Jay and Adnan become friends over weed and girls. That day Adnan lets Jay borrow his car and phone. Adnan leaves school with Hae to go talk in a mall parking lot. Jay eventually picks up Adnan. Witnesses claim they see them together. Adnan eventually pulls up to Jay's house and shows him Hae's body and asks for help. Adnan's cell phone pings various towers in proximity to all of these locations on that day (somewhat matching a chaotic time-line) Bottom line, Jay told 3-4 stories and in the end, none of them matched up perfectly, but then again Jay was a weed dealer that committed a Felony (maybe even a murderer). I'm not understanding this. The podcast tried to remain unbiased and gave us as many facts as possible. It wasn't a trial with admissibility/legal issues, it was a podcast on spotify. Not every fact is going to help, Adan. I believe she has complained before about the muslim aspect (possession/violence over women) being brought up, but the character of the suspect (especially for entertainment content) is very relevant and sometimes that is going to bleed into his culture/background. Is he the suspect mentioned in the state's new motion? do they name him?
siap, here is the motion: https://content.govdelivery.com/att...0053/Syed - Motion to Vacate - 09-14-2022.pdf
holy fuck, the state is all in on team Adnan. When will LA County step up for OJ?? Highlights imo: The state basically insinuated that they would not even use the cell phone tower evidence in a re-trial, as it is too misleading and unreliable (as if that has ever stopped the State before). They rip Jay's testimony, basically insinuate he would be discredited and worthless. They did not mention the suspects names, but they have 2 in mind, and they believe neither got investigated enough by law enforcement. It was hard for me to decipher which suspect was which, but one suspect went on to be a career criminal with violence against women, one suspect made threats against Hae, and one had a relative living at the house on the street that the car was ditched on. And what I have always been wondering, to what extent were those specific cops dirty? The detective on Adnan's case more or less set up another guy (in 1999) on a murder charge and that guy was exonerated in 2016. Most importantly, the prosecutor was given all the info on the two suspects, prior to trial, and did not disclose it with the defense (clear ground for a new trial). It appears the state will drop the charges instead of going to trial if Adnan is granted a new trial. Jay is shitting himself.
Adnan let jay borrow his car to go to the mall because he forgot to get his GF a bday present. Adnan was likely also banging jays gf but at the very least she was sitting on his lap in class snuggled up. Also adnan and jays gf we’re homecoming king queen. Jay had to be jealous. No way he wasn’t. the only time that day that hae and adnan were seen together was just after last bell when he asked her for a ride. She said she couldn’t. Nobody saw them after that together. The cell pings are worthless because they were mostly incoming. It said on the fax cover sheet that incoming pings aren’t useable. The prosecutor “lost the cover sheet” and adnans team nor the judge nor the testifying expert new the pings were meaningless. The expert has since recanted his statements after finding out about the fax cover sheet.
Either they are just doing the right thing finally or the evidence is strong enough that they know there is a lawsuit in their future and doing this to mitigate.
Sounds like they’re 110% convinced that they have the wrong guy and won’t be trying him again, should the motion be granted, based on this phrasing.
Legal eagles of the tmb mainboard, what does this mean as far as a new trial? Is the state obligated to pursue a new trial?
Can he get charged guilty again since it was overturned? I only ask because I’ve seen the blockbuster Ashley Judd movie “Double Jeopardy”
I don't remember specifics but I remember thinking there was no way they'd proved it beyond reasonable doubt so glad he's out.
Same. Wasn’t there no evidence either or am I misremembering that. It was basically just Jay’s testimony that they convicted him on
Yeah and that’s all they had for his conviction if I remember correct. Haven’t listened to it since it first aired and haven’t followed up on anything with the story
He wasn’t acquitted, so it’s as close to a legal clean slate as it gets, from a trial standpoint, the way I understand it.
He was released that quickly? Wow. What a day for him. I would have lost a lot of money had I bet on this one.
