KBJ’s dissent is worth the read. It’s as long as the majority and concurrences combined. Her analysis is far more deferential to Congressional intent in the uniqueness of the NLRB’s creation and authority. She illustrates how the majority opinion oversteps the role of the courts by itself applying an NLRB factual test analysis to determine if the strike was protected by the NLRA. This decision was about usurping authority away from the NLRB, and the way it was done is going to create the chaos in lower courts that Congress had hoped to avoid when it created the uniqueness of the NLRB to hear disputes as to what are protected actions under the NLRA first before a court could proceed with any claims. KBJ then went on to say that not only did the majority decide to wrongfully undertake this factual analysis, they the misapplied it based on how she believes the NLRB would find.

The law does require some mitigation of the effects of strikes, in some cases. But, to KBJ’s dissent, whether or not the union took proper actions is the exact factual analysis that the NLRB is to decide for itself. If the NLRB says the action is protected, the courts get no say as to whether it caused damages to the employer. Or at least that was the Congressional intent of the NLRA. Also, KBJ points out that after this case was dismissed by the WA Supreme Court because it ruled the NLRB first had to decide whether the strike was protected, not only did the General Counsel with the NLRB decide to pursue the retaliation claims against the company for how they responded to the union after the strike, but the NLRB has heard the arguments and is likely soon to rule. She suggested that on remand, the WA court dismiss or at least await this NLRB decision before moving on to its own decision making.
Sounds like Ben is saying that the only reason he is a “heterosexual” is because he believes it’s his duty to be heterosexual for the benefit of society. Perhaps if he didn’t believe that society would fall apart he would be free to be who he really wants to be.

Everyone here knows, but he obviously doesn't care about vaccines but views this as a legitimate achievement of his while he was in office and absolutely won't back down. The town I live in is very red, and the school system has a gay superintendent. She has been a teacher at the school system for her whole career, and there was never any issue with her being employed. Last year when she was an interim superintendent, there was huge backlash from a few churches and preachers (one who was on the school board). Students started protesting at the board office and ridiculing online the preachers and other people involved, which led to parents and churches that those students go to publicly (probably reluctantly) supporting her. Still had plenty of chuds trying to get her fired, but the board ended up hiring her and taking the interim tag off. The preacher on the board ended up having to give up his speaker position and just be a regular board member. The kids are tired of the bullshit, even in rural conservative towns.
