It's not illegal for a boss and an employee to have sex. The boss can get sued for unwanted shit but if they both consent then it's cool. I think teacher/student should be the same after a certain age. High school kid? No. But a 25 yr old grad student? Yes, I think that person should be able to have a consensual relationship with a teacher without the teacher going to jail. Now if the school wants to put a "No sex with students" rule in that has no age limits, that's on them. A company can do the same thing. I just don't think it should be illegal.
Not everyone is suited for different ages. A great 2nd grade teacher could struggle with high school and a great high school teacher could be a terrible 2nd grade teacher. It’s a dumb idea

You're missing the entire reason why these laws exist. It's all about being a gatekeeper to advancement and the impacts that has on ability to give free consent. Arguably, that dynamic is even stronger in grad school than high school, especially advisor/advisee situations.

Public funding is involved in most cases. That always complicates matters, and should. Even in the boss/subordinate situation, consent gets real murky real quick if things go south in the relationship. Unless you're a small/family business owner, you're a moron to mess around with romantic relationships with your subordinates. I do get the argument that criminality is up for debate, but if there's room for consent to be explicitly or implicity coersed, I think it's wise to err on the side of potential victims. It's about the ability to consent, which is always situational and makes everything in this area nuanced and murky as hell.
I'm ok if you want to make both illegal bc I absolutely see how consent can be murky in both situations. I just think it's odd that one is legal and one isn't when they are the same thing.
That's a fair point. Welcome to our criminal justice system. But the education system does make things different in the eyes of the (current) law, and I do think there's validity to education/academia being different from business. The gatekeeping isn't really the same at all.

I mean rape is against the law and if a person in power uses that power to get someone to sleep with him/her that is against the law. What I am talking about is consensual sex between a grad student and a professor. I don’t think it’s criminal by default.
It's not, but it can turn non-consentual at any time, just like any sexual encounter ever. And if it's a public institution, the investigation is going to be a lot different than the hush money you'll see in the business situation..
