i find the argument that conservative judges are more in line with elite right wingers than the base of the party, where as it seems the base (which are lots of cfb fans) think they'd be on their side pretty convincing, right wing elites didn't really care about gay marriage so the judges(who are elites themselves) followed fancy right wing lawyer elites don't give two shits about college football, so I imagine that will play out similarly. especially when the "conservative" angle is very very obvious.
The NCAA was doomed once they lost their indoctrinating video game that helped people not think too hard about what an evil organization they are. People will always and rightfully criticize FIFA but the organization will be fine because of their video game.

For perspective, Clarence Thomas once went 10 years straight from 2006-2016 without asking a single question in any case in any oral argument.
That was mostly because Scalia asked every question for the two of them and he was trying to save time, but even since, he's kept his questions to an absolute minimum.

Jeff Sutton has proven to be a decent 6th Circuit judge. Despite his political leanings, he truly tries to call balls and strikes, in the impartial sense. Sutton cast a 2-1 vote in favor of upholding Obamacare before the US Supreme Court affirmed 5-4.
