Their argument will be there is a constitutional right in the 2nd amendment to the right to own a firearm. Abortion was not written into the constitution and so therefore is left to the states.

It took me a minute, but Alito wrote into concurrence to a Supreme Court opinion that concealed carry laws on the books did nothing to prevent a white supremacist from committing an open act of terror, and are therefore not even useful. What's next, banning smoking on flights didn't prevent the passengers of the 9/11 flights from dying, so we can light up on our next Delta flight?

Eh, not really. It doesn't change the fact that the un-Mirandized statement is inadmissible in the criminal case. It just didn't create an independent tort for failure to Mirandize. As shitty as sovereign immunity is, that has largely been the law before this opinion.
