He keeps shaking his tail like like a rattle snake but there is no rattle. Let him out or kill it with fire?
There are a lot of North American species that shake their tail when agitated. Can't make it out on mobile, but there are a few in the south that could be that snake. There are no false rattles, though. Often times, snake tails can be bitten off or severed to give it the appearance of a rattle. Don't kill it, either. Animal Control or likewise.
It looks like a black racer. SE, active during the day, not venomous. What color is its chin and belly?
Looks like a rat snake or black racer to me, but I wouldn't get close enough to say for sure. Doesn't look like a cotton mouth from here. But it might be a cobra the way it can hold its head up.
This was my guess. Could it also be a black king snake? I know most have markings on the bottom but some are solid black.

Could be. Kingsnakes have some 10 or so relatives and look similar to that snake. Black kingsnakes are mostly found in rocky or lushly vegetated places, though.
haha, wife's extended family owns a large reptile farm so, while I hate snakes, I try to leave the "good" ones alone.
Only reason I recommended animal control is I didn't want your dog to aggro the snake later and get bitten.
My grandma used to kill moccasins and dblplay1212 won't even open a goddamn screen door to let the snake out of the patio.
