The 2nd cop was really professional and that shouldn't be lost because of that asshole detective. That Detective was way out of line fwiw I would of done the same things that kid in the car did if I was in his situation
I am sure that he is. But, somebody being the head of a group that has "Civil Rights" in the title doesn't mean he's necessarily always correct. It's an advocacy group. Their goal is to expand civil rights, which means they tend to have a pretty liberal view when it comes to the interpretation of the law. I do civil work, but from what I do know, I think he was a little fast and loose with some of those "has to's."
I've been pulled over because I fit a description. I was told to shut off my truck and get out of it. They also told me to stand next to the truck and not move. I did all those things. After about 5 minutes (felt like forever) they told me I could leave. They didn't act like god and I didn't feel like I needed to be a bad ass either.
I believe NNB is talking about doing a weapons frisk during a traffic stop. Supreme court has said cops have the right to order you out of your car once pulled over to do that. At least I believe that is what he is saying.

NoleNBlue Is a CCP holder obligated to inform an LEO that they have a weapon in the vehicle when pulled over (in Florida)? I've seen so much contradictory shit online that I don't know what's the truth at this point. I was told that in Arkansas you're not only not obligated to disclose that but that you shouldn't unless asked. I found that to be a really weird and suspicious policy. I've always just planned that if I'm pulled over while I have a firearm in my vehicle to calmly disclose it as soon as the officer asks for me license and information.
Pretty sure it varies by state, in KY you do. Soon as the tag is run we know whether there is a CCDW license for the registered owner/operator. Better to do as you planned, and ask what they want you to do in regards to it.
My bad, I was wrong on the get out of the car part. The officer does have to have probable cause for a frisk though. An armed burglary is probable cause the suspect is armed. A traffic violation isn't.
In Ohio it's your duty to inform. Every time I do the cop says (in a joking manner) "OK, well I wont pull mine if you don't pull yours"
Yea I'm not sure on the law but when I've been pulled over with a gun in my car my procedure is... Have hands on the steering wheel before they get to my window, inform any passengers to keep their hands in plain view, and tell the cop as soon as he's at my window "I have a pistol in the car, and I do have my ccw permit". I also tell them where it is right away. This has kept every encounter very stress free.
Reasonable suspicion of a crime doesn't give you reasonable suspicion to frisk; they're two different standards. Is there a case beyond Pennsylvania v. Mimms that you're relying on? That clearly distinguishes between the order to step out of the car (no reasonable suspicion required) and the subsequent frisk (controlled by Terry).

She is so stupid, everyone know you should use the Geneva convention treaty, you just have to declare yourself as an enemy combatant of the United States. She should also let the judge know that she doesn't recognize his authority to preside over her trial, she'll be home free in no time.
