If he retires I seriously doubt the Dolphins fight it. I'm not a doctor or a lawyer, but to me it seems pretty obvious that Tua can find a long list of neurologists that say he should never take another snap. Regardless of "cleared" or not, that's not a battle the Dolphins should fight or one that they can even win if they chose to fight it.

feel like there will be a lot of lawyers involved and that injury guarantee number will be negotiated down significantly. Having said that I would be shocked if Tua retired anytime soon. He is not very smart and is surrounded by a lot of people that depend on him financially. Galu probably doesn't even believe in concussions or CTE. Not to mention the Dolphins have handled this whole situation about as feckless as possible.
Not even counting his extension he's made like $50M in NFL salary not counting what he's made in endorsements and such. His family is fine even if he never saw a dollar of his extension. Hopefully his wife can get through to him
It's absolutely a winnable battle. It's just one you will lose in the court of public opinion. Like I said, it's the difference of what you can do v. what you should do. Because this all has cap implications, the odds of "do the right thing" winning are practically zero.
