I worry about stuff like this with my brother. He is a much different person now than when he first started. He had an incident a few years back really mess with him mentally. I wish he would find a new profession.

what part of that field sobriety test did she fail?? she seemed to walk the line perfectly, didn't screw up the number of steps, kept counting aloud every step. Then did the one-legged stand thing and counted to 22 I think. I am not sure I can do that right now at noon on a wednesday without wobbling. She also counted to one-one thousand, two-one thousand, all the way to 22 without screwing it up once. She seemed pretty unimpaired to me. And is that right, if you take a breathalizer 2 hours later, they calculate what your BAC level was 2 hours ago? Is that accurate? Do people metabolize alcohol at a slower/faster rate than others? There is no fucking way that's an accurate measure of her BAC at the time of the arrest, right?
Obviously none of us can see the Horizontal Gaze Nystagmus Test (Eye Test). The decision point is 4 clues on this test. So if he observed 4, then he theoretically could make an arrest decision off those 4 clues alone. On the walk and turn, just going off what I can see... I observed TWO clues during instruction phase. (1) Starting too soon (2) Cant keep balance during instruction. During the performance of the test I can not see enough to grade all he clues but I know for sure she conducted an improper turn which would be a 3rd clue. So at least 3 clues total on Walk and Turn. As far as the Intoxylizer goes, the actual BAC at arrest can be extrapolated from the result at the jail if there is worry that subject was actually under .08 when arrested.
I always wanted to know how many stone cold sober people can pass those tests. my rough estimate is zero. I'd argue that the officer was very unclear as to when she was supposed to start. he seemed to be done with his instructions, she started walking, and then he started explaining more. Did he say initially: wait for me to say "ok, now begin" or something, before you begin? if not, then this is BS. Because there is always the fear that you are not going to start on time, and the officer then says: she waited too long to start. Can't keep balance during instruction?? is that part of the test? She's standing there heel to toe for like 4 minutes while he explains everything. And it's windy, you can hear the wind in the mic. I'd be furious if that was one of the reasons given for failing the test. The turn? I am not even sure what the fuck he means by keep your front foot forward and make a series of small steps to turn around. What I'm envisioning in my mind is ridiculous. Like I pivot on the ball of my right foot, and make 8 or 9 small steps in a circle with my left foot until I've turned 180 degrees? what? Let's be honest, these tests are designed to fail anyone the officer wants to fail. They throw more instructions at you than you can reasonable recall, then force you to not only remember everything, but also perform flawlessly, under the pressure of potential arrest. I'd like to see the officer perform the ENTIRE test every time he explains it.

I don't know enough of the facts to say who should be sued/arrested. idk the laws on it either. If she said that to King, she should be responsible in some way. idk if that means she gets sued or if she actually filed a complaint against the cop meaning she could be charged for false accusations. If King was just reporting what he was told, I don't think he should be held accountable for reporting a story he was told. The law may say otherwise, I honestly don't know. I will say it's funny that you gloss over posts like this: yet come to defend the honor of a falsely accused cop.
